Session 7, April 3, 2023
Mayor Robert Benson called the 7th Regular Session of Council to order on Monday, April 3, 2023. Mayor Benson began the meeting with a prayer and the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Joseph Kammer, Daniel Rouse, Molly Lehman and Josh Smith. Abby Gallion attended via Zoom. Justin Cline arrived after roll call. Also attending the meeting were Fiscal Officer Kim Meek-Obed, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren and resident Chauni Skirtich. Resident Roger Balala arrived later in the meeting.

Mr. Smith motioned to approve the minutes of the 6th Regular Session of Council held on March 20, 2023. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Five yes votes. Minutes approved.

FINANCE
Fiscal Officer Kim Meek-Obed distributed a list of the bills and claims to Council. Ms. Meek-Obed reported she acquired a credit card through Huntington Bank. She received training this week from Huntington Bank regarding the online banking and credit card account information. She spoke with the State Auditors and they are preparing a letter of engagement that will need signed by the Village of Navarre, which will give them permission to begin the 2022 reconciliations. Ms. Meek-Obed reported she is manually entering the budgetary information from January through March into the new software program. Once that has been completed she will be able to begin using the new program daily.

ORDINANCE AND RESOLUTIONS
Ordinance 3-2023, an ordinance approving the Fiscal Officer’s residence to be outside of the Village ORC 733.263(D), was given a third and final reading. Mr. Smith offered, Ms. Lehman seconded Ordinance 3-2023 be placed in final passage. Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes, Gallion yes. Six yes votes. Ordinance 3-2023 declared duly adopted.

Ordinance 7-2023, an ordinance conditionally repealing Ordinance 12-2022, to be passed as an emergency. Mr. Smith offered and moved to accept Ordinance 7-2023 and declared same to be an emergency. Ms. Lehman seconded. Smith yes, Lehman yes, Rouse yes, Cline yes, Kammer yes, Gallion yes. Six yes votes. Motion carried. Ordinance duly adopted.

Ordinance 7-2023, Mr. Smith moved, Mr. Kammer seconded rules requiring three separate readings of Ordinance 7-2023 be suspended. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Rules requiring three separate readings suspended.

Resolution 2023-9, a resolution permitting payment of Village bills when or before due, with the prior discussed change, was given a third and final reading. Mr. Smith offered and moved to accept Resolution 2023-9. Ms. Lehman seconded. Lehman yes, Rouse yes, Cline yes, Kammer yes, Gallion yes, Smith yes. Six yes votes. Resolution 2023-9 accepted.

SOLICITOR
Fiscal Village Solicitor Attorney Terry Seeberger reported that Village Administrator Zachary Wisselgren signed the Design Loan Agreement with the Ohio EPA last week. Attorney Seeberger also advised that himself and Mr. Smith are still working out the details of the Studer/Kirby annexation and hope to have something ready for Council on that by April 17, 2023. Attorney Seeberger said he contacted the Stark County Building Department and was advised that the Village of Navarre is not permitted to take back control of commercial properties and leave the industrial properties with the Stark County, as that would not be in compliance with the Ohio Revised Code. He mentioned the Village could take both back from Stark County, but there are drawbacks associated with that also.
Village Solicitor Attorney Terry Seeberger reported he was in contact with representative regarding the ODSA Grant that was used for the Sterilite Street Project. Attorney Seeberger suggested keeping the grant open for further reimbursement requests.

PUBLIC PARTICIPATION
Roger Balala expressed concerns about certain trees in the Village tree lawns that he would like to see come down. He also mentioned there is a hole on Center Street that needs attention.

ADMINISTRATOR
Village Administrator Zachary Wisselgren reported the Navarre-Bethlehem park bathrooms were opened today. One of the lines blew apart and will be repaired tomorrow. Mr. Wisselgren said he will contact Thompson Electric for pricing of traffic lights.

MISCELLANIOUS
Mr. Cline reminded Council of the Easter Egg Hunt on Saturday at the Navarre-Bethlehem Park. Vicki Owen-Merry requested the dumpster be moved from the current location at the park, it was placed near the building. He questioned if any decision has been made about Keeferview Street. Mr. Wisselgren stated patch work was done on Keeferview. Mr. Cline said that Jim Urbach asked if someone could repair the sink at the park. Mr. Wisselgren said the line that blew at the park will be repaired tomorrow.

Mr. Rouse asked who owns the fence on the towpath and it was determined that the fence is owned by Nickle’s Bakery.

Ms. Lehman reminded Council that there will a “Coffee with Council” at Andersons on April 15, 2023 from 9-11am.

Mr. Smith said he will follow up with Mr. Kirby regarding annexation and easement. Mr. Smith said he will also follow up with the owners on Park Street regarding the email Mr. Smith forwarded to all Council Members.

BILLS AND CLAIMS
Mr. Smith moved to approve bills and claims in the amount of $571,831.67. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Bills and claims approved.
