Session 21, November 6, 2023
Mayor Robert Benson called the 21st Regular Session of Council to order on Monday, November 6, 2023. Mayor Benson began the meeting with a prayer and the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Carla Carl, Joe Kammer, Justin Cline, Daniel Rouse, Molly Lehman and Josh Smith. Also attending the meeting were Fiscal Officer Kim Meek-Obed, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Police Chief Chad Shetler, Police officers Daniel Kirby and Mike Pomesky, Margaret Cotton from the Garden Club, residents Andrew and Rhonda Nicewander, Bob & Linda Palmer, Amber Osmor, Scott Kirby and Dave Johnson and his daughter Katie Johnson and his mother Barb Johnson.

Mr. Cline made the motion to approve the minutes of the October 16, 2023 meeting with the correction as noted and Mr. Smith seconded. Cline yes, Kammer yes, Carl yes, Smith yes, Lehman abstain, Rouse yes. Five yes votes. Motion carried. Minutes approved.

Mayor Benson read a proclamation dedicating a memorial bench in front of Village Hall in memory of Anne L. Johnson.

Mayor’s Proclamation in memory of Anne L. Johnson


Whereas: It is among the responsibilities and privileges of the Mayor of the Village of Navarre to recognize occasions of outstanding significance, and;

Whereas: Anne L. Johnson took on the responsibility of Navarre Clerk-Treasurer in January 2007, and;

Whereas: Anne L. Johnson served the Village of Navarre for 16 years, with her work being audited every two years with satisfactory findings by the Auditor of State, and;

Whereas: in the 16 years that Anne L. Johnson served the Village, she was not known to take a vacation or even take many days off, and;

Whereas: Anne L. Johnsons’ dedication as Navarre’s Clerk-Treasurer position was only surpassed in importance by Anne’s family and church responsibilities.

Whereas: Anne L. Johnson, while getting ready to go to the office on January 2. 2023, fell ill and was taken to the hospital. Anne left this life to spend her eternal life with our Lord on January 6, 2023.


Therefore: In recognition of Anne L. Johnsons’ memory and her years of dedication to the Village of Navarre. The Navarre Village Council chooses to have a bench placed at Navarre Village Hall in memory of Anne. The employee’s, official’s along with this Council hope that Annes’ memory as a dedicated Mother, wife and yes, the last Clerk-Treasurer of the Village of Navarre will always be remembered when looking at, or sitting on this memorial Bench.

Mr. Rouse made a motion to dedicate the bench in front of Village Hall in memory of Anne L. Johnson and Ms. Lehman seconded. Rouse yes, Lehman yes, Smith yes, Carl yes, Kammer yes, Cline yes. Six yes votes. Motion carried. Dedication approved.

PUBLIC PARTICIPATION
Mr. Palmer spoke on the property on Park Street that he owns and his son lives in. He showed some pictures of work that he has been doing on the property. He stated that he is trying to be compliant but the neighbors are doing a lot of complaining. He asked who processed the citation and it was explained to him that the council through the police department issued the citation. He stated that he is going to court later in the week.

Margaret Cotton spoke on behalf of the Navarre Christmas in Bethlehem celebration and parade that will take place on Friday evening, November 10th. She is asking for council to pay for a second musical performer at the celebration in the amount of $100.00.
Ms. Carl made a motion to pay $100.00 for the music to be provided by Chris McBurney and Mr. Smith seconded. Carl yes, Lehman yes, Cline yes, Smith yes, Rouse yes, Kammer yes. Six yes votes. Motion passed.

Ms. Cotton will get the information for the checks to the Fiscal Officer so she can do the checks.

Mr. Scott Kirby asked if the Blough Avenue property that is being annexed will still be able to have hunting permitted. Solicitor Seeberger stated he will draw up something to permit that. He also asked if the village will still be paying for part of the cost of the engineering on that property and was told that it would still be paid.

POLICE SAFETY
Police Chief Chad Shetler reported that his month end report will look different because he changed back to the State reporting system. Chief Shetler and Administrator Wisselgren have discussed where to put the speed signs. Chief Shetler reported that he has talked with Perry Twp. Regarding the Special Response Unit (SRU) truck that they have available. He also reported that Brewster is looking to get rid of a cruiser and they want to trade for a camera system that we have. He is looking for the okay to proceed with the purchase of the SRU and the trade for the cruiser.

Mr. Smith made a motion to enter into an agreement with Brewster to trade a 2015 Explorer for a Watchguard in car video system and Mr. Kammer seconded. Smith yes, Rouse yes,
Kammer yes, Cline yes, Lehman yes, Carl yes. Six yes votes. Motion passed.

Mr. Smith asked Chief Shetler if the SRU is needed or if we can charge batteries in our cruisers. Chief Shetler had Detective Pomesky explain the need and usefulness of this unit. At this time council decided not to move forward with the purchase of the SRU. Chief Shetler also noted that Brewster would like to purchase some radios from our police department.

Mr. Smith made a motion to sell the radios to the Brewster police department for $3,000.00 and Ms. Carl seconded. Carl yes, Cline yes, Lehman yes, Kammer yes, Rouse yes, Smith yes. Six yes votes. Motion carried.

FINANCE

Fiscal Officer Kim Meek-Obed reported that she is still working on getting things answered and back to the State Auditors to answer questions that they have about 2022 but it is very time-consuming because she has to look back into a lot of records to try to figure out the answers.

ORDINANCE AND RESOLUTIONS
Resolution 2023-36, a resolution to pay Northstar Asphalt for pay application #4 for the Reconstruction of East Canal Street.
Ms. Lehman made a motion to pay Northstar for pay application #4 and Mr. Kammer seconded. Lehman yes, Rouse yes, Cline yes, Kammer yes, Carl yes, Smith yes. Six yes votes. Motion carried.

Resolution 2023-37, a resolution to increase water reconnection fees.
Ms. Lehman made a motion to have first reading of Resolution 2023-37 and Mr. Smith seconded. Some changes were noted that needs to be made before the final passage of the resolution. Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes, Carl yes. Six yes votes. Motion carried.

SOLICITOR
Solicitor Terry Seeberger requested that council go into executive session to discuss possible litigation.

Mr. Kammer made a motion to go into executive session per Mr. Seeberger’s request and Ms. Lehman seconded. Kammer yes, Carl yes, Smith yes, Lehman yes, Rouse yes, Cline yes. Six yes votes. Into executive session at 8:27 p.m.

Mr. Smith made a motion to return from executive session and Ms. Lehman seconded. Smith yes, Lehman yes, Rouse yes, Cline yes, Kammer yes, Carl yes. Return from executive session to regular meeting at 8:37 p.m.

MAYOR
Mayor Benson passed around two thank you notes that he received for council to see.

ADMINISTATOR
Administrator Zachary Wisselgren reported that he got a quote to move the kiosk of about $1,200.00. Mr. Smith asked if we could wait till the new year to do this. Ms. Lehman stated that we may be able to get some assistance to pay for this and asked Mr. Wisselgren to get her a copy of the quote so she can check into getting this paid for.
Mr. Wisselgren also discussed was the pickle ball courts. He got a quote from Vasco of between $100,000 - $150,000 for four courts. If we put two courts in it would be about $75,000 OR we could go with $33,453 for repairing and filling the cracks but keeping the existing asphalt. We would be using the Block Grant money to pay for this.

Mr. Wisselgren also reported that we are going to be putting out for bid for the street paving projects.

MISCELLANEOUS
Mr. Kammer told Zack that Grace Christian Church wants to know if they can get their Christmas lunch put on the sign. He reported that he will not be here on November 20th.
Mr. Cline attended the Bethlehem Twp. Parks Board meeting last week and they are planning some things for next year.
Mr. Rouse just reminded everything to vote.
Ms. Lehman reported that the fence behind Nickles is going to come down and Nickles will move some of the parking stops. She has no updates on the agreement for NTR canoe. She provided copies of quotes for re-vamping the website. Regarding traffic at Sterilite and Fohl we need to change the signage for truck traffic from Tractor Supply. Wants to schedule a Coffee with Council on January 20th.
Mr. Smith wanted to approve that Mr. Appleby be allowed to widen his driveway and Zack will follow-up with him. There had been a good group at the last Coffee with Council and it was discussed that we are going to buy 30 new Christmas lights for next year.

BILLS AND CLAIMS
Mr. Smith moved to approve bills and claims in the amount of $183,725.33. Mr. Kammer seconded. Carl yes, Kammer yes, Cline yes, Smith yes, Lehman yes, Rouse yes. Six yes votes. Motion carried.
