Session 3, February 6, 2023
Mayor Robert Benson called the 3rd Regular Session of Council to order on Monday, February 6, 2023. Mayor Benson began the meeting with a prayer and the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse and Josh Smith. Molly Lehman was excused from the meeting. Also attending the meeting were Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Police Chief Chad Shetler, Sergeant Dan Kirby, Erie Valley Fire and Rescue Chief Rick Annen, Reverend Dennis Landan and Jason Kirby. Residents Bill Miknis, Chauni Skirtich and Scott Kirby were also present.
Mr. Smith motioned to approve the minutes of the 2nd Regular Session of Council held on January 23, 2023. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Minutes approved. SAFETY POLICE Chief Chad Shetler went over the monthly police report with Council. They have received no update from Beach City regarding the amended contract. He spoke about the short of staff situation he is experiencing with the Massillon Law Directors Office. SAFETY FIRE Erie Valley Fire and Rescue Chief Rick Annen went over the yearly report with Council. There was a total of 1222 call for the year, which is up about 100 from the year before and up 80% from six years ago. He reported their department is the only fire department in the County that responds to every call. SOLICITOR Village Solicitor Attorney Terry Seeberger spoke about the need for Resolution 2023-7. He discussed with Council the annexation for services agreement with Kirby Brothers LLC. Mr. Smith motioned to have Attorney Seeberger prepare a resolution for same. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. Attorney Seeberger mentioned that Resolution 2023-4 will need amended after the December withholding payments have been received. Lastly, he advised there is a Mediation Hearing set for April 1, 2023 on the Durant property. ORDINANCE AND RESOLUTIONS Resolution 2023-7, a resolution authorizing the extension of the agreement with the Massillon Law Director for prosecution. Mr. Smith offered and moved to accept Resolution 2023-7. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Resolution 2023-7 accepted. MAYOR Mayor Robert Benson said he received nice thank you cards from the Belloni and Johnson Families. He mentioned the next scheduled Council Meeting falls on a paid holiday for the Village and asked if Council would like to hold the meeting or reschedule it. It was determined that the meeting will be held as scheduled. ADMINISTRATOR Village Administrator Zachary Wisselgren said he gave Mayor Benson a letter of recommendation to hire Kim Meek-Obed for the Fiscal Officer Position. He also discussed with Council a letter from the Tax Administrator. MISCELLANEOUS Ms. Gallion said there was a Safety and Streets Committee Meeting tonight. They would like to hold a public meeting to discuss streets in the Village. She said they are still working on signage for the new truck route. She reported the CDBG funding has been wrapped up so the public hearing on that should be released soon. Mr. Smith said he has drafted a change to the current pay ordinance and has requested Council to review same. The date of March 13, 2023 was agreed upon for the public hearing at 6:30 pm. BILLS AND CLAIMS Mr. Smith moved to approve bills and claims in the amount of $94,978.07. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes.
