Session 17, September 5, 2023
Mayor Robert Benson called the 17th Regular Session of Council to order on Tuesday, September 5, 2023. Mayor Benson began the meeting with a prayer and the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Carla Carl, Joe Kammer, Justin Cline, Daniel Rouse, Molly Lehman and Josh Smith. Also attending the meeting were Fiscal Officer Kim Meek-Obed, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Vick Owen-Merry of the Navarre-Bethlehem Park Board, business resident Keith Hancock and Village residents Chauni Skirtich, Andrew Nicewander and Rhonda Nicewander.

Mr. Smith motioned to approve the minutes as corrected of the 16th Regular Session of Council held on August 21, 2023. Mr. Cline seconded. Carl yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Minutes approved.


PUBLIC PARTICIPATION
Keith Hancock, owner of Rise Up Café, questioned if the property located at 531 Main Street North could be split and rezoned to make the home residential and the building commercial? Attorney Terry Seeberger stated Council would be permitted to approve the lot split and advised Mr. Hancock on how to get the process started. Mr. Hancock also asked about additional parking for employees of Rise Up Café, at which time Council suggested and granted permission for Rise Up Café to use the Civic Center Parking lot.

Vicki Owen-Merry of the Navarre-Bethlehem Park Board provided updated information about the park grants. She reported the “Flags of Freedom” event will be held this upcoming weekend at the park. Vick Owen-Merry mentioned there will be a Park Board Meeting on September 28, 2023 at 6:00 pm. She also apprised all of what is currently going on at the park with updates.


FINANCE
Fiscal Officer Kim Meek-Obed reported she is still working with the State Auditor’s Office. She stated it is taking longer than she expected to complete due to the amount of time required for research to obtain the information they are requesting of her.


ORDINANCE AND RESOLUTIONS
Resolution 2023-28, a resolution renumbering Ordinance 2-2023 passed May 15, 2023 to Ordinance 8-2023. Mr. Smith motioned to accept Resolution 2023-28. Ms. Lehman seconded. Rouse yes, Kammer yes, Smith yes, Cline yes, Carl yes, Lehman yes. Six yes votes. Motion carried. Resolution 2023-28 accepted.

Resolution 2023-29, a resolution refund under the TSC Job Creation Tax Credit Agreement. Ms. Lehman motioned to accept Resolution 2023-29. Ms. Carl seconded. Rouse yes, Lehman yes, Smith yes, Carl yes, Kammer yes, Cline yes. Six yes votes. Motion carried. Resolution 2023-29 accepted.

Ordinance 13-2023, an ordinance amending section 76.99 Parking Offense Penalties, was given a second reading by title only.

Ordinance 14-2023, an ordinance defining the truck route through Navarre, excluding Market Street, Regulation Section 70.21. Mr. Smith motioned to approve Ordinance 14-2023 with the addition of Park Street and Mr. Cline seconded. Cline yes, Carl yes, Lehman yes, Kammer yes, Smith yes, Rouse yes. Six yes votes. The first reading was given.
SOLICITOR
Village Solicitor Attorney Terry Seeberger spoke on the position of the Waste Water Treatment Plant Expansion Project.
Attorney Seeberger reported there is a new fence at the Park Street property. The resident has been served with a notice to clean-up the property. Attorney Seeberger went over the options available to the Village, should the resident fail to properly respond to the clean-up notice. Mr. Smith motioned to have Jim Neely, Zoning Inspector/Property Maintenance Officer, deliver a citation to the Park Street property, while accompanied by the police. Mr. Kammer seconded. Lehman yes, Carl yes, Cline yes, Rouse yes, Smith yes, Kammer yes. Six yes votes. Motion carried. This issue will be revisited in a future meeting.

MAYOR
Mayor Benson requested a motion to go into executive session. Mr. Cline made the motion and Mr. Kammer seconded. Smith yes, Lehman yes, Rouse yes, Cline yes, Kammer yes, Carl yes. Six yes votes. Motion carried; executive session entered at 8:08 pm. Mr. Smith made a motion to return from executive session. Ms. Lehman seconded. Carl yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Executive session ended at 8:14 pm. Mayor Benson noted there would be no action taken with Ordinance 4-2023, Ordinance 5-2023 and Ordinance 6-2023.

ADMINISTATOR
Village Administrator Zachary Wisselgren said the speed signs have been ordered and they are expected to be delivered in 4-6 weeks. The no-parking signs have been installed out front of Nickles Bakery. The street striping and curb repainting should be completed today. NorthStar will be back on Friday to complete their work.

MISCELLANEOUS
Mr. Cline remined that “Flags of Freedom” will be held this weekend at the Navarre-Bethlehem Park.

Mr. Rouse informed he will not be at the next Council Meeting.

Ms. Lehman said there will be a meeting this Thursday at Rise Up Café at 6:00 pm to discuss the status of Christmas in the Village and the Navarre Business Association. She reported she spoke to Stark Parks regarding the condition of the fence behind Nickles parking lot and there is a discrepancy to who owns/maintains the fence. She stated she attended the CDBG Grant Workshop and she shared an email she received regarding last year’s project. Lastly, she advised she checked into permits on the flea market building and reported they have obtained the required permits.

Mr. Smith obtained Council’s consent to send out the letter he prepared in support of the Farmer’s Market.

BILLS AND CLAIMS
Mr. Smith moved to approve bills and claims in the amount of $119,362.47. Ms. Lehman seconded. Rouse yes, Cline yes, Kammer yes, Carl yes, Smith yes, Lehman yes. Six yes votes. Motion carried.
