Session 16, August 19, 2019
Mayor Robert Benson called the 16th Regular Session of Council to order on Monday, August 19, 2019. Prior to the meeting, Clerk-Treasurer Anne Johnson met with the Finance Committee at 6:30 pm to review the audit correspondence paperwork. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Pat Winkhart, Don Berkey, Liz Urbach, Robin Keith, Daniel Rouse and President Pro Temp Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Navarre Zoning Inspector Jim Neely and Independent Reporter Eric Poston.
Ms. Winkhart moved to approve the minutes of the 15th Regular Session of Council held on August 5, 2019. Ms. Keith seconded. Winkhart yes, Berkey yes, Urbach yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Minutes approved. FINANCE Clerk-Treasurer Anne Johnson gave Council a copy of today’s check register and the bills and claims. It was noted that social security numbers should be blacked out on tax refund vouchers that can be viewed by the public. ORDINANCE AND RESOLUTIONS Ordinance 13-2019, an ordinance adopting and enacting Regulation 151.54 Cell Tower Placement and Construction, was given a third and final reading. Mr. Netzly motioned to approve Ordinance 13-2019. Ms. Keith seconded. Winkhart yes, Berkey yes, Urbach yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. Ordinance 13-2019 duly adopted. Ordinance 14-2019, an alternative tax budget ordinance, to be passed as an emergency. Resolution 2019-4, a resolution approving and adopting the extension an alternative method for apportioning the Stark County undivided Local Government Fund for 2020 through 2022. SOLICITOR Navarre Village Solicitor Attorney Terry Seeberger explained a proposal letter he plans to prepare for Council. Considering the tax abatement for Hendrickson, Perry Local Schools will only receive forty percent of the property tax revenue owed. The Ohio Revised Code has a provision for income tax revenue sharing to compensate school districts for lost tax revenue. During the abatement period, Perry School District and the Village of Navarre can negotiate an agreement on sharing the new income taxes to be received. Attorney Terry Seeberger will move forward with the proposal for Perry Local School Board. Attorney Terry Seeberger reported that the Village of Navarre and the Stark County Board of Trade has received $790,000.00 from the Ohio Department of Transportation to fund the extension of Sterilite Street. This extension project will be bid for in the spring. Meanwhile, Hendrickson needs a passable road for their construction period. Beaver Construction Agency already has equipment at the site. Considering the Cooperative Development Agreement, Attorney Terry Seeberger believes that Stark County Board of Trade can move forward with the road for the purpose of public improvement with a Memorandum of Understanding and an Indemnity Agreement. Mr. Netzly made a motion to approve that the Village Administrator and the Mayor be authorized to approve said plan and budget, if said plan and budget appear acceptable to them, subject to a Memorandum of Understanding between the Village of Navarre and Stark County Board of Trade and DeHoff Development Company in a form acceptable to the Village Solicitor. MAYOR Mayor Robert Benson reappointed Attorney Terry Seeberger as the Navarre Village Solicitor for the period of August 19, 2019 through August 18, 2021 and requested Council’s consent. Mayor Robert Benson read the 2019 Proclamation about Prostate Cancer Awareness and proclaimed September as Prostate Cancer Awareness month: “Whereas: This year approximately 174,650 men will be diagnosed with prostate cancer in the United States alone every year – that’s one man every 3.2 minutes and roughly 31,620 die this year from the disease – which is 87 men every day; and Whereas: in Ohio an estimated 5,340 new cases of prostate cancer will be diagnosed and an estimated 1,130 deaths will occur in 2019; and Whereas: Men with relatives – father, brother, son – with a history of prostate cancer are twice as likely to develop the disease; and Whereas: Prostate cancer is most commonly diagnosed cancer in American Men and the second leading cause of cancer death behind long and colon cancer; and Whereas: Men who served in the military who have been exposed to chemicals and herbicides are at a higher risk for developing prostate cancer; and Whereas: 1 in 9 men are diagnosed with prostate cancer in his lifetime. Overall, African American men are 1.7 times more likely to be diagnosed with -- and 2.3 times more likely to die from -- prostate cancer than white men; and Whereas: Education regarding prostate cancer and early detection strategies is critical to saving lives, preserving, and protecting our families. The economic and social hardship it has on the families is huge; and Whereas: Nearly 3 million men in the U.S. are living with a prostate cancer diagnosis; that number is estimated to climb to 4 million by 2024 as men in the baby boomer generation age; and Whereas: all men are at risk for prostate cancer and we encourage the citizens of the village of Navarre and the Navarre area to increase the importance of prostate screening. Therefore: I, Mayor Robert L. Benson Proclaim, September as Prostate Cancer Awareness Month in the Village of Navarre and encourage all citizens to understand the importance of prostate screening and to encourage all citizens to speak to love ones of that importance. Benson, Mayor” ZONING INSPECTOR Zoning Inspector/Property Maintenance Officer Jim Neely stated now that the cell tower ordinance is completed, it can be distributed to those who have inquired about it. He also reported that the properties owned by Katina Spanos are showing some improvement and that someone is looking into building a house on the lot located at corner of Jacob Street and Cedarmont Street. MISCELLANEOUS Mr. Netzly motioned to cancel the Council Meeting scheduled for September 2, 2019 and advised a Special Meeting will be called if necessary. Ms. Winkhart seconded. Ms. Urbach reported that she attended a VONBA Meeting and also mentioned that the golf fundraiser for Navarre-Bethlehem Park is scheduled for October 6, 2019.
