Session 5, March 4, 2019
Mayor Robert Benson called the 5th Regular Session of Council to order on Monday, March 4, 2019. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Pat Winkhart, Don Berkey, Randy Hattery, Robin Keith, Daniel Rouse and Derek Netzly. Also attending the meeting were Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Navarre Police Chief Dennis Albaugh, VONBA President Adam Marcelli, Navarre Zoning Inspector Jim Neely, Independent Reporter Arezou Vakili, Sabrina Hattery, Calli Soehnlen, John Walsh, Tiffany Highben, Lydia Highben, Tim Short and Tim Short Jr, present for a communications class requirement.
Mr. Hattery moved to approve the minutes of the 4th Regular Session of Council held on February 18, 2019. Mr. Netzly seconded. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Netzly yes. Mr. Rouse abstained. Five yes votes. Minutes approved. PUBLIC PARTICIPATION Girl Scouts Lydia Highben and Calli Soehnlen presented Council a Silver Award project plan for bat houses in the parks. Mr. Netzly motioned to donate $300 for the project. Ms. Winkhart seconded. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion approved. Ms. Winkhart motioned to approve the project. Mr. Netzly seconded to approve the bat houses in the parks project. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. Project approved. SAFETY POLICE Police Chief Dennis Albaugh presented the monthly police report to Council. Police Chief Dennis Albaugh advised that the speed sign has been repaired. Police Chief Dennis Albaugh reported that Officer Mitch King was rear-ended while on duty over the weekend. Police Chief Dennis Albaugh stated Coffee with Matt will be this Tuesday at Anderson’s at 6:00 pm. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the February financial statements and the bills and claims. ORDINANCE AND RESOLUTIONS Ordinance 3-2019, an ordinance regulating Itinerant Retailers, repealing Ordinance 10-2018 and 23-2019 was given a third and final reading. Mr. Netzly motioned to approve Ordinance 3-2019. Ms. Keith seconded. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. Ordinance 3-2019 duly adopted. Ordinance 5-2019, an ordinance approving re-plat of properties of Stark board of Trade LLC, creating a 35 acre parcel in Prospect Park and extending Sterilite Street to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 05-2019 and declared same to be an emergency. Ms. Winkhart seconded. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. Ordinance 5-2019 accepted. Ordinance 5-2019, Mr. Berkey moved, Ms. Keith seconded rules requiring three separate readings of Ordinance 5-2019 be suspended. Motion carried. Ordinance 5-2019 duly adopted. SOLICITOR Village Solicitor Attorney Terry Seeberger reported that an arbitrator has been assigned to the AT&T case. Attorney Terry Seeberger stated that under the Clean Water Plan the eastern part of Prospect Park has never been prescribed as an area to be sewered. He advised this will be changed. MAYOR Mayor Robert Benson reported that there is an issue for the Property Maintenance Committee and Property Maintenance Officer Jim Neely, regarding a property located on Basin Street. Mayor Benson advised that the Property Maintenance Committee needs to meet to discuss the issue. STREETS AND ALLEYS A quote was provided by Thompson Electric to add a generator panel to the traffic light at a cost of $1055.00 UTILITIES Village Administrator Zachary Wisselgren said that the Waste Water Treatment Plant received their new NPDES permit. MISCELLANEOUS Village Administrator Zachary Wisselgren reported that the Storm Water Management Plan is completed. The plan has been approved by Stark Soil and Water and will be forwarded to the Environmental Protection Agency. Village Administrator Zachary Wisselgren advised that the Storm Water Annual Report is due April 1, 2019. Clean–Up Day in the Village is scheduled for April 6, 2019. Ms. Winkhart distributed the minutes from the Utility Committee Meeting. The Street Committee discussed preparing an information card to mail out with the water bills this month. A public hearing about the income tax increase will be held April 10th at 1:00 pm and 7:00 pm at the Navarre Civic Center. The Street Committee would like to see an ordinance where people are not permitted to shovel or blow snow into the street or onto their neighbor’s property. The same would hold true of grass, leaves and debris with said ordinance. Mr. Rouse said the Park Board is requesting $150.00 for the Easter Egg Hunt. Mr. Rouse motioned to approve the $150.00 donation to the Park Board. Ms. Keith seconded. Winkhart yes, Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. Mr. Netzly reported there will be a Council of the Whole meeting on March 18th at 6:00 pm to discuss utilities, the new street ordinance and anything else that may arise.
