Session 2, January 21, 2019
Mayor Robert Benson called the 2nd Regular Session of Council to order on Monday, January 21, 2019. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Don Berkey, Randy Hattery, Robin Keith and Derek Netzly. Pat Winkhart was excused from the meeting. Also attending the meeting were Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Navarre Police Chief Dennis Albaugh, Erie Valley Fire and Rescue Chief Rick Annen, Navarre Zoning Inspector Jim Neely, Navarre Garden Club members Pam Stickle and Sheryl Westland, VONBA members Claudia Anderson, Adam Marcelli, and Latecia Sukosd and Independent Reporter Arezov Vakili.

Mr. Netzly moved to approve the minutes of the 1st Regular Session of Council held on January 7, 2019. Ms. Keith seconded. Berkey yes, Hattery yes, Keith yes, Netzly yes. Four yes votes. Minutes approved.

Mr. Rouse arrived to the meeting at 7:05pm.

PUBLIC PARTICIPATION
The Garden Club would like to put a cabinet in the Civic Center to store some items. Mayor Benson stated there is already a cabinet in the basement that the Garden Club may use.

VONBA representatives were present at the meeting to discuss the Itinerant Ordinance. They presented Council with a corrected membership sheet that showed 56% of the members are in the Village of Navarre. Mr. Netzly stated that he does not feel any organization should have to pay to run an event in the Village.

Mr. Netzly motioned. Mr. Rouse seconded to amend the ordinance that any 501 C organizations in Navarre be exempt from itinerant merchant fees. Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Five yes votes. Motion carried. Registration and background checks will still be required. It was Council’s intent from the beginning to help protect VONBA for their events.

SAFETY FIRE
Erie Valley Fire and Rescue Chief Rick Annen distributed the monthly and annual fire report. The fire department was staffed for 72 hours during the storm.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the bills and claims and a certificate of the total amount of funds available from all sources.

ORDINANCE AND RESOLUTIONS
Ordinance 2-2019, an ordinance of 2019 Permanent Appropriations $5,717,268.55. Mr. Netzly motioned to approve Ordinance 2-2019. Ms. Keith seconded to approve Ordinance 2-2019. Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Five yes votes. Motion carried. The first reading was given.

Ordinance 21-2018, an ordinance permitting Navarre-Bethlehem Community Park Board to appoint two members to the board, as opposed to the appointment of one member, was given a third and final reading. Mr. Rouse motioned to accept Ordinance 21-2018. Mr. Netzly seconded. Berkey no, Hattery yes, Keith yes, Rouse yes, Netzly yes. Four yes votes. Motion Carried. Ordinance 21-2018 duly adopted.

MAYOR
Mayor Robert Benson stated he was proud of everyone’s work this weekend with the weather and water leak.
STREETS AND ALLEYS
The Street and Alley Committee came up with a list for paving. The Village will complete two $50,000 projects.

UTILITIES
Village Administrator Zachary Wisselgren advised the Day Avenue property has been brush hogged.

Village Administrator Zachary Wisselgren reported there were two water leaks and he thanked Mayor Benson for bringing food on Sunday to the location where work was being done on a leak.

MISCELLANEOUS
Village Administrator Zachary Wisselgren said there will be a sanitary inspection in March at the Water Treatment Plant.

Zoning Inspector Jim Neely said the property owners at 19 Canal Street East have ordered materials for repairs. He also advised that the new owner of 47 Canal Street West would like to have the property rezoned, and reported the owner of the two Park Street properties has a new property manager.

A discussion took place about Ordinance 24-2018 regarding truck weights in the alleys. Ms. Keith motioned and Mr. Berkey seconded to change the ordinance from 5,000 pounds to 10,000 pounds. Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Five yes votes. Motion carried.

Ordinance 28-2018 was discussed regarding license fees, insurance requirements and bonds. Mr. Berkey motioned and Mr. Hattery seconded to change the license fee to $25 and waive the fee for 2019 and change the insurance requirement to $250,000.00 with no bond requirement. Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Five yes votes. Motion carried.

Village Solicitor Attorney Terry Seeberger reported the AT&T matter is in arbitration and that AT&T is considering making an offer of settlement.

Minutes were received from the Street and Alley Committee.

BILLS AND CLAIMS
Ms. Keith moved to approve bills and claims in the amount of $49,288.66. Mr. Netzly seconded. Berkey yes, Hattery yes, Keith yes, Rouse yes, Netzly yes. Five yes votes. Bills and claims approved.
