Session 11, June 15, 2020
Mayor Benson called the 11th Regular Session of Council to order on Monday, June 15, 2020. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Pat Winkhart, Justin Cline, Liz Urbach, Daniel Rouse, Joshua Smith and President Pro Temp Derek Netzly. Also present at the meeting were the Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Zoning Inspector Jim Neely, John Houston and Louise Myers.

Mr. Netzly moved to approve the minutes of the 10th Regular Session of Council held on June 1, 2020. Ms. Urbach seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Mr. Rouse abstained. Five yes votes. Minutes approved.

PUBLIC PARTICIPATION
Louise Myers questioned the rules regarding free-standing signs at businesses. She stated she understands free speech but worried a comment on a sign in town is the type of statement that incites violence and makes the Village look bad. After reviewing the Village Ordinances, Solicitor Terry Seeberger determined the sign use is non-comforming to the business, but the owner is entitled to free speech. He advised he will prepare a letter for Council’s review.

John Houston expressed concern regarding the access to his father’s property at Prospect Park. He will work with Administrator Zachary Wisselgren on the access road and removal of some trees.

FINANCE
Clerk-Treasurer Anne Johnson gave Council a copy of today’s check register and the bills and claims.

SAFETY POLICE
The May Police Report was distributed to Council.

SOLICITOR
Attorney Seeberger reviewed the Ohio Public Meeting Law with Council in regards to emails. Attorney Seeberger also mentioned that the Fire Renewal Levy will be on the November ballot.

ORDINANCE AND RESOLUTIONS
Ordinance 11-2020, an ordinance enacting and adopting a supplement to the Code of Ordinances for the Village of Navarre was given a second reading by title only.

Ordinance 12-2020, an ordinance authoring the Clerk-Treasurer to accept “CARES” Act funds, amending Ordinance 3-2020 Permanent Appropriations and creating a separate fund to accept and hold “CARES” Act funds, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 12-2020 and declared same to be an emergency. Ms. Urbach seconded. Winkhart yes, Cline yes, Urbach yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Ordinance accepted.

Six yes votes. Motion carried. Ordinance accepted.

Resolution 2020-3, a resolution authorizing Mayor to renew Gas Aggregation Agreement with Volunteer Energy Services until September of 2022, keeping Navarre’s current arrangement to be billed 6% less by Columbia Gas to all participants in the Aggregation Program. Ms. Winkhart offered and moved to accept Resolution 2020-3. Ms. Winkhart seconded. Winkhart yes, Cline yes, Urbach yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Resolution 2020-3 accepted.

STREETS AND ALLEYS
Village Administrator Zachary Wisselgren reported that concrete was poured in front of Village Hall today and that new railing will be installed soon. He advised the Street Department is working on catch basins. The Village is concentrating on getting the streets paved and will then work on the gutters and curbs in the Village.

UTILITIES
Village Administrator Zachary Wisselgren reported there was another water leak and that water meters will be read this week.

MISCELLANEOUS
Council and Mayor Benson discussed buying NOAA Radios to sell to residents for weather alerts. Ms. Winkhart motioned, Ms. Urbach seconded to purchase NOAA Radios to sell at Village Hall. Winkhart yes, Cline yes, Urbach yes, Rouse no, Smith no, Netzly no. Three yes votes. Three no votes. Mayor Benson no. Motion defeated.

Ms. Winkhart questioned if the street specs are done and said we should stark working on sewer upgrade plans. Ms. Winkhart also stated she has no intention of defunding our Police Department and said she would like to give them a vote of confidence.

Ms. Urbach advised mulch work was done at the Navarre-Bethlehem Park and reported there will be a ribbon cutting ceremony at Navarre-Bethlehem Park on Saturday at 9:00 for the new park equipment.

BILLS AND CLAIMS
Mr. Netzly moved to approve bills and claims in the amount of $215,135.25. Mr. Smith seconded. Winkhart yes, Cline yes, Urbach yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Bills and claims approved.
