Session 14, August 2, 2021
President Pro Temp Josh Smith called the 14th Regular Session of Council to order on Monday, August 2, 2021. Mr. Smith began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Pat Winkhart, Joe Kammer, Justin Cline, Daniel Rouse, Joshua Smith and Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Matt Crum and Chase Gordon.
Ms. Winkhart moved to approve the minutes of the 13th Session of Council held on July 19, 2021. Mr. Cline seconded. Winkhart yes, Cline yes, Rouse yes, Smith yes. Four yes votes. Minutes approved. Mr. Kammer and Mr. Netzly abstained. Ms. Winkhart moved to approve the minutes Special Session of Council held on July 22, 2021. Mr. Rouse seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Minutes approved. Mr. Netzly abstained. PUBLIC PARTICIPATION Chase Gordon stated he supports medical marijuana and said it helps his wife and has positive effects. Matt Crum reported he is against having a medical marijuana dispensary in the Village. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the July financial statements and the bills and claims. ORDINANCE AND RESOLUTIONS Ordinance 10-2021, a previously tabled ordinance amending Zoning Code new section 151.43, regulating marijuana related uses, no action taken. SOLICITOR Village Solicitor Attorney Terry Seeberger advised there are two versions of Ordinance 10-2021. Attorney Terry Seeberger discussed the zoning options. A public hearing will be scheduled for the Navarre Planning Commission and the neighbors will be notified. ADMINISTRATOR Village Administrator Zachary Wisselgren advised pay application #3 for the Sterilite Street Extension Project will be presented at the next Council Meeting. Mr. Wisselgren reported the Water Department will be doing lead and copper sampling this month. Mr. Wisselgren also reported the Sewer Department had the Flow Meter recalibrated. He said the County will be asked to move their meter closer to the Waste Water Treatment Plant. MISCELLANEOUS Ms. Winkhart stated the Police Department does not have an issue with a medical marijuana dispensary in the Village. Ms. Winkhart said she attended the Mid’s meeting with Zachary Wisselgren and Terry Seeberger. Mr. Wisselgren was able to answer questions about Mid’s water flow. Mid’s is planning a five million dollar expansion and would like to have recently purchased properties rezoned. Attorney Terry Seeberger stated the rezoning applications for Mid’s properties have been received. Ms. Winkhart stated there will be a Sausage Drive Thru on August 13, 2021, hosted by Saint Clements Church. The drive thru will be held from 4:00 pm – 8:00 pm. Touch-A-Truck will be at the Towpath YMCA on the same date from 5:00pm – 8:00pm. Mr. Netzly reported the first Monday of September as Labor Day and motioned to cancel the Council Meeting set for same. Ms. Winkhart seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Netzly yes. Six yes votes. Motion carried. A Planning Commission Meeting will be planned and advertised. BILLS AND CLAIMS Mr. Netzly moved to approve bills and claims in the amount of $148,158.81. Mr. Rouse seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes.
