Session 17, October 4, 2021
Mayor Benson called the 17th Regular Session of Council to order on Monday, October 4, 2021. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Pat Winkhart, Joe Kammer, Justin Cline, Daniel Rouse, Josh Smith and Derek Netzly. Also attending the meeting were Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Erie Valley Fire Chief Rick Annen, Controller at Mid’s Tom Kayatin, Mid’s & RC Realty Attorney Scott Zurakowski.
Mr. Netzly moved to approve the minutes of the 16th Session of Council held on September 20, 2021. Mr. Cline seconded. Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Winkhart abstained. Five yes votes. Minutes approved. SAFETY FIRE Erie Valley Fire and Rescue Chief Rick Annen distributed reports to Council. Runs are up 25% from last year. An extra day person has been added to the shift, which is now at four. They are fortunate to be able to staff and not miss runs. They are helping at Altercare Nursing Home and with public assists. FINANCE Clerk-Treasurer Anne Johnson distributed to Council a copy of today’s check register, the September financial statements and the bills and claims. She reported the Village has received $95,000.00 from the American Rescue Plan Act. She sated the money is for costs directly related to the negative impacts of Covid 19, such as rental assistance, financial hardships to businesses directly tied to the pandemic and revenue loss. She said there is heavy emphasis on using it for water and sewer improvements along with broadband internet. ORDINANCE AND RESOLUTIONS Ordinance 10-2021, a previously tabled ordinance amending Zoning Code new section 151.43, regulating marijuana related uses, Mr. Smith motioned to remove it from table and Ms. Winkhart seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. There are two options available for the ordinance. Ms. Winkhart feels we should not hinder a business if it wants to come into town. Mr. Smith stated that the option being voted on states the business would need to go before the Board of Zoning Appeals. Mr. Smith motioned to place the ordinance into final passage. Mr. Netlzy seconded. Winkhart no, Kammer no, Cline no, Rouse yes, Smith yes, Netzly yes. Mayor Benson broke the tie with a yes vote. Ordinance 10-2021 declared duly adopted with the A & B options. Ordinance 14-2021, an ordinance addressing a rezone request for Mid’s property, reliant on Navarre Planning Commission pronouncement. Ms. Winkhart reported on the Planning Commission Meeting and said they voted 5-0 in approval of Mid’s rezone request and recommends approval. Village Solicitor Attorney Terry Seeberger noted the ordinance can be passed as an emergency. Mr. Netlzy offered and moved to accept Ordinance 14-2021 and declared same to be an emergency. Ms. Winkhart seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Ordinance accepted. Ordinance 14-2021, Ms. Winkhart moved. Resolution 2021-12, a resolution authorizing payment to United Earthworks #5 for Sterilite Street Extension #3. Ms. Winkhart offered and moved to accept Resolution 2021-12. Mr. Netzly seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Resolution 2021-12 accepted. SOLICITOR Village Solicitor Attorney Terry Seeberger reported he is working with Village Zoning Inspector/Property Maintenance Officer Jim Neely on sending out notices to residents regarding property violations. He said he received a letter about a sewer connection from 1946, but noted the statute of limitations on such is two years. MAYOR Mayor Benson read the following note from the historical society: “Dear Mayor Bob, Thanks for all the support the Village has given us over the years. We had another successful car show on the 26th and we wanted you to know we appreciate having permission to close Basin Street. We had cars parked down to Park Street. Thanks again. Sincerely, Smitty” Mayor Benson suggested the Village contribute to the Towpath Trail Annual Halloween Community Party. Mr. Netlzy motioned to donate $500.00 to the YMCA for the event and Mr. Cline seconded. Kammer yes, Cline yes, Rouse yes, Smith yes, Netlzy yes. Winkhart abstained. Five yes votes. Motion carried. Mayor Benson reported that Columbia Gas will have a GPS Team working in the Village throughout October. Mayor Benson mentioned the State of Ohio Proclamation 2020 Federal Census of 2020 lists the Navarre population at 1846 residents. Lastly, Mayor Benson shared a letter written by Mr. Smith addressed to the Stark County Commissioners. Mayor Benson said he will get Council a copy of the sidewalk ordinance. ADMINISTRATOR Village Administrator Zachary Wisselgren reported the intended streets have been paved; however, berms need finished and a few driveways need limestone. Mr. Wisselgren would like the Street Committee to have a meeting to determine which streets will be paved next year and he hopes to see Canal Street on the list for next year. Mr. Wisselgern mentioned the sidewalk ordinance states we should check sidewalks in the Village and he requests the Street Committee address this issue at the meeting as well. Mr. Wisselgren advised leaf pickup begins in the Village on October 11, 2021. Brush pickup has concluded for the year but can still be taken to the yard waste pit at the Waste Water Treatment Plant. Mr. Wisselgren said truck traffic should not be operating on Wooster Street and suggested routing truck traffic onto Market Street. A new sludge pump was received for the belt press at the Waste Water Treatment Plant. In closing, Mr. Wisselgren advised hydrants in the Village will be flushed beginning on October 12, 2021 and will continue until complete. MISCELLANEOUS The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm, weekends and holidays from 8:30 am to 11 am. Mr. Wisselgren reported cemetery foundations will be completed next week. Ms. Winkhart said the YMCA would like to update their sign and request we cover a quarter of the cost. She also asked if there will be more swings placed at the Market Street Park. Mr. Wisselgren responded there is not enough room for everything at the Market Street Park that the YMCA would like to have. Ms. Winkhart reported she has received complaints regarding the property at 100 East Canal/Tuscarawas. Attorney Terry Seeberger responded the complainants need to contact Jim Neely/Property Maintenance Officer. Lastly, Ms. Winkhart said cards need to be sent out to residents regarding the November election and that a public meeting will be held in Council Chambers on October 19, 2021 from 10-11 am and 6:30-7:30 pm to discuss the November election. Mr. Cline reported receiving complaints about truck traffic on Center Street. Mr. Rouse stated people are speeding on the newly paved streets. BILLS AND CLAIMS Mr. Smith moved to approve bills and claims in the amount of $162,316.21. Mr. Cline seconded. Winkhart yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes.
