Session 22, December 2, 2019

Mayor Robert Benson called the 22nd Regular Session of Council to order on Monday, December 2, 2019. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Pat Winkhart, Don Berkey, Liz Urbach, Robin Keith, Daniel Rouse and President Pro Temp Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Navarre Zoning Inspector Jim Neely, Independent Reporter Eric Poston, Fechko Excavating General Manager Greg Peterson, Stark Board of Trade Representatives Bob DeHoff and Mark Samolczyk.

Mr. Netzly moved to approve the minutes of the 21st Regular Session of Council held on November 18, 2019. Ms. Winkhart seconded. Winkhart yes, Berkey yes, Urbach yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Minutes approved.

FINANCE
Clerk-Treasurer Anne Johnson gave Council a copy of today’s check register, the bills and claims and the November financial statements.

SOLICITOR
Village Solicitor Attorney Terry Seeberger explained that Ordinance 23-2019 authorizes the Village to enter into a contract with Stark Board of Trade for infrastructure improvements inside of Prospect Park. He advised there are grant funds that should be received from OSDA for $712,000.00 and from Ohio Department of Transportation for $97,100.00.

He reported Ordinance 24-2019 will establish a Tax Increment Financing District for Hendrickson, USA. The funds will be used for infrastructure in the Park.

He said Ordinance 25-2019 allows the Village to use $65,906.00 of the Job Ready Site Grant funds towards the Water Booster Project in the Park.

He advised that Resolution 2019-8 allows a disbursement of the Job Ready Site Grant funds to Stark Board of Trade for $416,327.94 for further development in the Park.

Attorney Terry Seeberger explained that Ordinance 26-2019 awards the contract for the Sterilite Street Construction work to United Earthworks. Attorney Seeberger reviewed the bids with the Engineer and they both recommend United Earthworks. Greg Peterson of Fechko Excavating noted that the bid proposed a completion date eight weeks beyond the mandatory completion date. Greg Peterson also stated that Fechko’s bid submission complied with all of the requirements of the bid package, including the requirement of experience. Greg Peterson said he feels Fechko Excavating met the bidding qualifications where the other contractor did not.

Attorney Terry Seeberger recommended Council hold off on awarding the contract one week to give Fechko Excavating a chance to make their case to the Engineer. He said the Engineer has a good history with United Earthworks. Mr. Netzly motioned, Ms. Keith seconded to table Ordinance 26-2019 until next Monday. Winkhart yes, Berkey yes, Urbach yes, Keith yes, Rouse yes, Netzly yes. There will be a special meeting next Monday, December 9, 2019 at 7:00 pm.

Resolution 2019-7 authorizes payment for the Water Pressure Booster Project.
Attorney Terry Seeberger noted that he has enjoyed working with Bob DeHoff and he appreciates the work he has done for economic development in the area.

Bob DeHoff said that the Prospect Park Project would not have moved forward without the commitment of the Village of Navarre.

Attorney Terry Seeberger said he created Ordinance 27-2019 by request of the Police Chief. Council discussed the ordinance and the feline problem in the Village.

Resolution 2019-7, a resolution authorizing payment of balance of Water Pressure Booster Project contract. Mr. Netzly offered and moved to accept Resolution 2019-7. Ms. Winkhart seconded. Winkhart yes, Berkey yes, Urbach yes, Keith yes, Rouse yes, Netzly yes. Six yes votes. Resolution 2019-7 accepted.

Resolution 2019-8, a resolution authorizing Village Administrator and Clerk Treasurer to make disbursement to Stark Board of Trade pursuant to Cooperative Development Agreement. ZONING
Village Zoning Inspector Jim Neely reported the property located at 19 Canal Street has contracted with the Weston Company for repairs to the building. The prosecutor will hold off action for now. The next one that will be submitted to the prosecutor is the Feed Mill. The Property Maintenance Committee would like to start meeting with the Zoning Inspector.

SREETS AND ALLEYS
This is the last week for leaf season. After December 6, 2019 leaves must be bagged and set out at the curb.

Some potholes in the Village have been patched.

UTILITIES
The Booster Station has been set on the foundation. Contractors are working on piping, electrical and communications.


MAYOR
Mayor Benson read a thank you note he received:

Mayor Benson appointed himself to the Navarre Bethlehem Joint Fire District Board of Trustee’s for 2020-2021, as Navarre’s Official on the Board. Mayor Benson requested Council’s motion of acknowledgement of appointment. Minutes will authenticate appointment. Ms. Urbach motioned to acknowledge appointment, Ms. Winkhart seconded. MISCELLANEOUS
The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm, weekends and holidays from 8:30 am to 11am.

The Bucket Van broke down.

Plans are being made to expedite snow plowing this winter.

At the first of year, Village Administrator Zachary Wisselgren will meet with the Street Committee to discuss bid specs for road work.

Village Administrator Zachary Wisselgren will meet with Engineer Don Dummermuth to start plans for the Sewer Plant improvements.

Mr. Berkey reported that he is moving out of the Village and is giving up his seat at the end of the year.

Ms. Urbach met with Stark County Economic Development and reported they are a good resource for businesses and they have low interest rate loans.

Ms. Keith thanked the Village for fixing the road at the bridge.

Mr. Netzly reported he will be accepting letters of interest for the two vacant Council Seats until December 13, 2019.

Mr. Netzly motioned to hold a Special Council Meeting on December 9, 2019 at 7:00 pm to discuss the contractor ordinance and any other business that may arise.
