Session 10, June 1, 2020
Mayor Benson called the 10th Regular Session of Council to order on Monday, June 1, 2020. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Pat Winkhart, Justin Cline, Liz Urbach, Joshua Smith and President Pro Temp Derek Netzly. Mr. Rouse was not in attendance of the meeting. Also present at the meeting were the Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren and Clerk-Treasurer Anne Johnson.

There was no one in attendance from the public at the Zoning Hearing which was held prior to the Council Meeting in Council Chambers. All Council Members attended with the exception of Daniel Rouse, who was not present at the meeting.

Mr. Netzly moved to approve the minutes of the 9th Regular Session of Council held on May 18, 2020. Mr. Smith seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Minutes approved.

FINANCE
Clerk-Treasurer Anne Johnson gave Council a copy of today’s check register, the May financial statements and the Bills and Claims for review.

PLANNING COMMISSION
Planning Commission Chair Person Ms. Winkhart distributed the minutes of the Planning Commission Meeting held on May 28, 2020 and reported the Commission is in approval of the proposed Ordinance 8-2020.

ORDINANCE AND RESOLUTIONS
Ordinance 8-2020, an ordinance amending Navarre Codified Municipal Regulation 151.51.2, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 8-2020 and declared same to be an emergency. Mr. Smith seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Motion carried. Ordinance accepted.

Ordinance 8-2020, Ms. Winkhart moved, Mr. Smith seconded rules requiring three separate readings of Ordinance 8-2020 be suspended. Winkhart yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Five yes votes. Rules requiring three separate readings suspended.

Ordinance 8-2020, Ms. Winkhart moved, Ms. Urbach seconded Ordinance 8-2020 be placed in final passage. Winkhart yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Five yes votes. Motion carried. Ordinance 8-2020 duly adopted.

Ordinance 9-2020, an ordinance enacting section 10.19 of the Navarre Codified Municipal Regulations, was given a third and final reading. Mr. Netzly offered, Ms. Winkhart seconded Ordinance 9-2020 be placed in final passage. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Ordinance 9-2020 declared duly adopted.

Ordinance 10-2020, an ordinance enacting new section 90.07 of the Navarre Codified Municipal Regulations. Ms. Winkhart moved to accept Ordinance 10-2020. Mr. Smith seconded. Winkhart yes, Cline no, Urbach no, Smith yes, Netzly no. Two yes votes. Three no votes. Ordinance defeated.

Ordinance 11-2020, an ordinance enacting and adopting a supplement to the Code of Ordinances for the Village of Navarre. Mr. Netzly moved to accept Ordinance 11-2020. Ms. Urbach seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Motion carried. The first reading was given.

Resolution 2020-2, a resolution authorizing payment of United Earthworks Pay Application #2. Mr. Netzly offered and moved to accept Resolution 2020-2. Mr. Smith seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Resolution 2020-2 accepted.

MISCELLANEOUS
Zachary Wisselgren reported that the tree on Market Street was taken down and that the water has been turned on for the construction crew installing the Navarre-Bethlehem Park equipment. He also reported there was a water leak over the weekend and that new service was started for a new house and he advised that mowing letters need to be sent out.

Ms. Urbach said mulch will be put in at Navarre-Bethlehem Park next week and advised that a rail is needed for the ramp. Ms. Urbach motioned to pay $1,000.00 for a ramp and Mr. Netzly seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Motion carried.

Mr. Netzly said that work needs done in front of Village Hall. He said new concrete and railings are needed.

Ms. Winkhart questioned when the doors at Village Hall will be open. Mayor Benson noted that a plastic shied was installed in the lobby at Village Hall and stated we are following the bank on opening to the public. He said the Village is trying to protect the elderly residents.

BILLS AND CLAIMS
Mr. Netzly moved to approve bills and claims in the amount of 138,867.79. Ms. Urbach seconded. Winkhart yes, Cline yes, Urbach yes, Smith yes, Netzly yes. Five yes votes. Bills and claims approved.
