Session 12, June 21, 2021
Mayor Robert Benson called the 12th Regular Session of Council to order on Monday, June 21, 2021. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Pat Winkhart, Liz Urbach, Justin Cline, Daniel Rouse and Joshua Smith. Derek Netzly was excused from the meeting. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, First Energy Advisors Director of Sales Lori Rader and Angel Dottavio via Zoom.

Ms. Winkhart moved to approve the minutes of the 11th Session of Council held on June 7, 2021. Ms. Urbach seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Minutes approved.

PUBLIC PARTICIPATION
Lori Rader of First Energy Advisors noted the Power Aggregation Plan needed updated. The new Aggregation Plan is with Constellation Energy. Notifications were mailed to residents.

POLICE SAFETY
The March Police Report was distributed prior to the Council Meeting.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims.


ORDINANCE AND RESOLUTIONS
Ordinance 10-2021, an ordinance amending Zoning Code new section 151.43, regulating marijuana related uses, Attorney Terry Seeberger noted there are two versions of the ordinance to choose from. Council discussed with Attorney Terry Seeberger the different zoning options. The Board of Zoning Appeals would still have to approve an application. Mr. Smith motioned to choose the amended version. There was not a second. Ms. Urbach motioned to table the ordinance, Ms. Winkhart seconded. Winkhart yes, Urbach yes, Cline no, Rouse yes. Four yes votes; one no vote. Motion carried.

Ordinance 12-2021, an ordinance submission to electors proposed additional one quarter percent income tax, was given a second reading with the discussed changes by title only.

Ordinance 13-2021, an ordinance authorizing the update to Electric Power Aggregation Plan, to be passed as an emergency. Ms. Winkhart offered and moved to accept Ordinance 13-2021 and declared same to be an emergency. Mr. Cline seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. Ordinance accepted.

Ordinance 13-2021, Ms. Urbach moved, Mr. Smith seconded rules requiring three separate readings of Ordinance 13-2021 be suspended. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Rules requiring three separate readings suspended.

Ordinance 13-2021, Ms. Winkhart moved, Ms. Urbach seconded Ordinance 13-2021 be placed in final passage. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. Ordinance 13-2021 duly adopted.

MAYOR
Mayor Benson thanked Council Member Liz Urbach for her years of service and wished her the best for her future.

Mayor Benson read a letter from Judge Frank Forchione:


“Dear Mayor Benson,

I just wanted to take the time to congratulate you on the acquisition of the Tractor Supply Company moving its facility to Navarre. It certainly is welcome news and was exciting to hear that is will create several hundred jobs. I know how hard you’re working to bring new business into the area, and it’s a feather in the cap of Village Counsel, the Village Solicitor, and all the others who helped make it happen. Keep up the great work.

Mayor Benson advised Attorney Terry Seeberger wrote the JEDD Agreement twenty-eight years ago. He said it was the first one in Ohio.

Mayor Benson noted that there are four Council seats open for this year. He said petitions need to be returned to the Board of Elections by August 5, 2021 to be placed on the November ballot.

Mayor Benson questioned if there will be a Council Meeting on July 5, 2021 and it was determined the next Council Meeting will be held on July 19, 2021.

ADMINISTRATOR
Village Administrator Zachary Wisselgren reported Columbia Gas is doing work in town and that it could interrupt Village paving plans.

Mr. Wisselgren said the Sewer Department is checking the Flowmeter in the County sewer line to determine how much is actually coming thru the line.

Mr. Wisselgren advised he will be attending a meeting tomorrow with a potential new tenant for Prospect Park.

Mr. Wisselgren stated he is working on additional park equipment for the Market Street Park.


MISCELLANEOUS
Ms. Winkhart reported residents in the Shadow Lawn Allotment have been complaining about the dust created from the dirt being moved at Prospect Park.

Mr. Smith reported there was a Council of the Whole Meeting at 6:00 pm to interview the three applicants for the open Council seat. The interviewed applicants were Angel Dottavio, Joseph Kammer and Molly Lehman. Mr. Smith motioned to appoint Joseph Kammer for the remainder of Ms. Urbach’s term. Ms. Urbach seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried.


BILLS AND CLAIMS
Ms. Urbach moved to approve bills and claims in the amount of $40,392.96. Mr. Smith seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Bills and claims approved.
