Session 10, May 17, 2021
Mayor Robert Benson called the 10th Regular Session of Council to order on Monday, May 17, 2021. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Pat Winkhart, Liz Urbach, Justin Cline, Daniel Rouse and Joshua Smith. Derek Netzly was excused from the meeting. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren and Matt Crum.

Ms. Winkhart moved to approve the minutes of the 9th Session of Council held on May 3, 2021. Ms. Urbach seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Minutes approved.

SAFETY POLICE
The Navarre Police Report was distributed to Council. Everyone has recovered from COVID-19.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims.

ORDINANCE AND RESOLUTIONS
Ordinance 8-2021, an ordinance enacting a tax compensation formula for the Village of Navarre and Fairless School District with respect to the Tractor Supply Facility in Prospect Park was given a third and final reading. Ms. Winkhart offered, Ms. Urbach seconded Ordinance 8-2021 be placed in final passage. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Ordinance 8-2021 declared duly adopted.

Ordinance 9-2021, an ordinance enacting a tax compensation formula for the Village of Navarre and the Perry Local School District with respect to the Tractor Supply Facility in Prospect Park, was given a third and final reading. Ms. Urbach offered, Mr. Smith seconded Ordinance 9-2021 be placed in final passage. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Ordinance 9-2021 declared duly adopted.

Ordinance 10-2021, an ordinance amending Zoning Code new section 151.43, regulating marijuana related uses. Ms. Winkhart offered and moved to accept Ordinance 10-2021. Mr. Cline seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. The first reading was given.

Resolution 2021-5, a resolution authorizing the Nature Works Grant Application for Market Street Park walking track. Mr. Rouse offered and moved to accept Resolution 2021-5. Ms. Urbach seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Resolution 2021-5 accepted.

SOLICITOR
Village Solicitor Attorney Terry Seeberger presented Council with an ordinance regulating a marijuana dispensary, an inquiry was made to the Zoning Inspector regarding same. A discussion ensued, and Ms. Winkhart offered to accept Ordinance 10-2021 as stated above. Attorney Terry Seeberger said he will create a second version of the ordinance.

MAYOR
Mayor Benson reported that Council Member Liz Urbach is resigning effective June 30, 2021, as she is moving out of the Village. He stated petitions need to be turned into the Board of Elections by August 5, 2021 for the November election. There are four Council seats up this year.

ADMINISTRATOR
Village Administrator Zachary Wisselgren reported paving bids were opened last week and the low bid was from NES Corporations for $310,730.00 for the project. Attorney Terry Seeberger advised he will prepare an ordinance to accept the bid. Zachary Wisselgren said that himself, the Mayor and Stark Board of Trade are to meet with Stark County Commissioner Bill Smith to discuss upgrades to the Waste Water Treatment Plant. Zachary Wisselgren said the grant for the walking trail at Market Street Park is due June 1, 2021 and advised the boarder needs put for the new park equipment and mulch needs applied to the area. Concrete work will be done at the pavilion.

MISCELLANEOUS
The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm, weekends and holidays from 8:30 am to 11 am.

Ms. Winkhart motioned to have Attorney Terry Seeberger prepare the documents required to have the income tax issue placed on the November ballot. Mr. Smith seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. The issue failed at the May 5, 2021 election.

St. Clements Sausage Drive Thru and Mini Festival are scheduled for June 11-12, 2021.

Ms. Urbach gave Zachary Wisselgren some suggestions for the grant support.

Zachary Wisselgren reported the streets in the Village are set to be swept on May 26, 2021.

Mr. Rouse expressed more mulch is needed in Navarre-Bethlehem Park. He would like to discuss plans for a dog park.

Mr. Smith suggested mentioning the open Council seat in the Far Corner.

Mr. Smith motioned and Mr. Cline seconded Attorney Terry Seeberger preparing a public records request policy. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried.

BILLS AND CLAIMS
Ms. Urbach moved to approve bills and claims in the amount of $68,602.13. Mr. Smith seconded. Winkhart yes, Urbach yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Bills and claims approved.
