Session 9, May 2, 2022

Mayor Robert Benson called the 9th Regular Session of Council to order on Monday, May 2, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Josh Smith and Derek Netzly. Daniel Rouse was excused from the meeting. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger and Village resident Robin Keith, Bethlehem Township Trustees Mark Dearing, Jim Urbach and Renee Veselenak, Bethlehem Township Fiscal Officer Jody Matics and Landscape Architect Katherine Holmok of Environmental Design Group.

Mr. Netzly moved to approve the minutes of the 8th Regular Session of Council held on April 18, 2022. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Minutes approved.

PUBLIC PARTICIPATION
Resident Robin Keith reported she has noticed dirt bikes on streets and she said they are not legal on the roads.

Landscape Architect Katherine Holmok spoke to Council about a proposed improvement project for the jointly owned Navarre-Bethlehem Park. Grants are available to help with the probable costs. Grants are used to help with watershed management. There is a lot of flooding and erosion in the park. A wetland creation would help to alleviate the flooding. There would be a natural stream bank stabilization along the stream. Sandstone block could be used for the children to play in the stream. The grants are not guaranteed. Bethlehem Township is requesting the Village agree to contributing half of the cost. The first cost being the design fee of $50,000.00. Grant applications to follow. After further discussion, Mayor Benson noted that Council would not be ready to make a decision regarding the project tonight. A decision can be made at the next Council Meeting. Mark Dearing noted that plans are being made for road improvements coming off of Fohl Road. Mr. Smith inquired as to how the flow of water from Prospect Park would affect the project. There would be hydraulic flow monitoring. Jody Matics noted the Township would have to take out a loan for the project and then pay it back as grant money is received. Mr. Netzly would like to schedule a Council of the Whole Meeting at 6:30 pm on May 16, 2022 to discuss the project.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the April financial statements and the bills and claims.

SOLICITOR
Village Solicitor Attorney Terry Seeberger noted Ordinances 11-2022 and 12-2022, tax increment financing, are used to recoup costs of infrastructure through deferred property taxes. The Village will be using the funds to defray the cost of the expansion of the Water Treatment Plant. Notices will be sent to the State of Ohio and the County Auditor.

ORDINANCE AND RESOLUTIONS
Ordinance 10-2022, an ordinance amending zoning code 151.83, adding sections (F) and (G), was given a third and final reading. Mr. Netzly offered, Ms. Gallion seconded Ordinance 10-2022 be placed in final passage. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Ordinance 10-2022 declared duly adopted.

Ordinance 11-2022, an ordinance establishing Mid’s Pasta Sauce Non-Joint Fire District TIF, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 11-2022 and declared same to be an emergency. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Motion carried. Ordinance accepted.

Ordinance 13-2022, an ordinance regulating parking during snow emergencies, enacting Section 76.10 Regulation, was given a second reading by title only.

Mr. Smith motioned to approve the revision of Ordinance 14-2022. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Motion carried.

Ordinance 14-2022, an ordinance regulating parking during street sweeping, enacting Section 76.11 Regulation, was given a second reading by title only.


MISCELLANEOUS
Mr. Kammer reported he has received complaints about pot-holes in the Village.

Mr. Cline said Vicky Owen-Merry would like the bleachers removed from the old football field and moved to the baseball fields at the park.

Mr. Netzly made a motion and Mr. Cline seconded moving the dumpsters and removing the clothing drop-off box. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Motion carried.

BILLS AND CLAIMS
Mr. Netzly moved to approve bills and claims in the amount of $181,165.90. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Smith yes, Netzly yes. Five yes votes. Bills and claims approved.
