Session 21, December 5, 2022
Mayor Robert Benson called the 21th Regular Session of Council to order on Monday, December 5, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion via Zoom, Joseph Kammer, Justin Cline, Daniel Rouse and Josh Smith. Molly Lehman was excused from the meeting. Also attending the meeting were Clerk-Treasurer Anne Johnson and Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren and resident Steve Morelli.
Mr. Cline motioned to approve the minutes of the 20th Regular Session of Council held on November 21, 2022. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Minutes approved. PUBLIC PARTICIPATION Resident Steve Morelli wanted to know about the billboard at Hukill Tile. Mayor Benson reported there is nothing in the zoning code that prohibits a mobile billboard. Steve Morelli also asked about the car lot on Main Street, to which Mayor Benson stated that property is privately owned and there is nothing in the zoning code prohibiting having cars on the property. Mr. Morelli noted there is an old Ohio revised code requiring a fence around the property. Mr. Smith said he will look into it further. Mr. Morelli said if something sits on a property for sixty days, it is considered a junk yard. Mr. Morelli expressed his opinion that Council needs to take action on these items. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the November financial statements and the bills and claims. MAYOR Mayor Robert Benson stated there will be a Finance Committee Meeting to review the police budget and street paving plans, prior to the Council Meeting on December 19 at 6:15 pm. Mayor Benson reminded Council the meetings in January will be held on the second and fourth Monday, January 9th and 23rd. The remainder of the meetings will follow the normal Council Meeting schedule of the first and third Monday of the month. ORDINANCE AND RESOLUTIONS Ordinance 23-2022, an ordinance awarding the paving project to Northstar Asphalt, to be passed as an emergency. Mr. Smith offered and moved to accept Ordinance 23-2022 and declared same to be an emergency. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. Ordinance accepted. Ordinance 23-2022, Mr. Smith moved, Mr. Kammer seconded rules requiring three separate readings of Ordinance 23-2022 be suspended. Ordinance 23-2022 duly adopted. SOLICITOR Village Solicitor Attorney Terry Seeberger said he will look into the billboard claim and the issue with the property where cars are being refurbished. He also stated he received and reviewed the statements on qualifications for the Waste Water Treatment Plant Expansion Project with Administrator Zachary Wisselgren, Mayor Benson and President Pro-Temp Josh Smith. It will be brought up with Council in the future. ADMINISTATOR Administrator Zachary Wisselgren said he met with Thompson Electric about repairing the light at Main Street and Canal Street and putting in a new controller and emergency generator hook-up. Mr. Smith motioned to move forward with the work with Thompson Electric. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes. Motion carried. A discussion continued regarding the annexation and sewer line for the properties on Blough. The Engineer contacted Administrator Zachary Wisselgren about the agreement. There was a water leak on Oakbrook the Wednesday before Thanksgiving. Christmas lights will go up this week, but we need new Christmas decorations. Mayor Benson said decorations will go on sale after Christmas and Council can take a look at them then. MISCELLANEOUS Ms. Gallion said she is working on a railroad quiet zone. Mr. Kerby said traffic has improved on Market Street. Mr. Cline thanked everyone who attended the Street Committee Meeting. Mr. Smith distributed the minutes from the Street Committee Meeting. The second round of paving will be done in the fall. Discussion to continue regarding the assessments of Statements of Qualifications. BILLS AND CLAIMS Mr. Cline moved to approve bills and claims in the amount of $35,834.02. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes. Five yes votes.
