Session 17, October 3, 2022
Mayor Robert Benson called the 17th Regular Session of Council to order on Monday, October 3, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Molly Lehman and Josh Smith. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Erie Valley Fire and Rescue Captain Ryan Shanower, Doug Six, Mason Six and resident Steve Morelli. Ms. Gallion motioned to approve the minutes of the 16th Regular Session of Council held on September 19, 2022. Ms. Lehman seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Minutes approved. PUBLIC PARTICIPATION Doug Six of Fairless Youth Football requested a donation for new equipment. Mr. Smith motioned to donate $1000.00 to the Fairless Youth Football League. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried.
FIRE SAFETY Erie Valley Fire and Rescue Captain Ryan Shanower, who is also the Inspector for the Village of Navarre and Bethlehem Township, said a new business moved into the Village of Navarre that he was not aware of. He reported work was done at this new business location without obtaining a Certificate of Occupancy, which is required to open as well as a fire inspection. He is requesting to be notified when a business opens or applies to have water service put in their name. Ms. Lehman suggested putting together an informational welcome packet for new businesses. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of the September financial statements, today’s check register, the bills and claims and the minutes from the Council of the Whole Meeting held on September 19, 2022. SOLICITOR Village Solicitor Attorney Terry Seeberger discussed Ordinance 20-2022. Village Administrator Zachary Wisselgren said he would prefer to replace the single family equivalence calculation with actual meter readings. He also asked about the Joint Operating Maintenance Replacement Fund. Attorney Terry Seeberger said the County would like to have a monitoring committee for maintenance recommendations. Ms. Gallion stated she feels that having the County involved would benefit the Village down the road with future projects. Attorney Terry Seeberger said he would like to get the ordinance passed to put heat on the County and the Commissioners who are on contract for 77.85% of the project costs. This benefits the Village for future developments of Prospect Park. Attorney Terry Seeberger reviewed Ordinance 21-2022, a replat of two properties in the Village. After a discussion, it was determined no action would be taken. Attorney Terry Seeberger said we are pursuing Tax Increment Financing. After approval is received from the Ohio Department of Taxation, the money can be used to finance the expansion of the Waste Water Treatment Plant. ORDINANCE AND RESOLUTIONS Ordinance 19-2022, an ordinance enacting new section 10.20 regulation regarding repeat violations of maintenance regulation, was given a third and final reading. Mr. Smith offered, Mr. Kammer seconded Ordinance 19-2022 be placed in final passage. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Ordinance 19-2022 declared duly adopted. Ordinance 20-2022, an ordinance approving Navarre-Stark Sanitary Sewage Service Agreement, to be passed as an emergency. Mr. Smith offered and moved to accept Ordinance 20-2022 as revised and declared same to be an emergency. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Resolution 2022-12, a resolution authoring adoption of Stark County 2022 Hazard Mitigation Plan. Mr. Smith offered and moved to accept Resolution 2022-12. Ms. Lehman seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Resolution 2022-12 accepted. Resolution 2022-13, a resolution declaring 81 Ohio Street a public nuisance. Mr. Smith offered and moved to accept Resolution 2022-13. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Resolution 2022-13 accepted. MAYOR Mayor Robert Benson stated Stark County Council of Government requested the approval of an ordinance approving and adopting the extension of an alternative method of apportioning the Stark County Undivided Local Government Fund. Mayor Benson said the Park Board should make the decision regarding using Navarre-Bethlehem Township Community Park Board authority with relationship of Bethlehem Township and the Village of Navarre. ADMINISTRATOR Village Administrator Zachary Wisselgren reported that residents are not moving their cars to off-street parking for the street sweeping service. He also reported the insurance adjuster noted the Village is on notice for liability if someone reports a tree issue. MISCELLANEOUS Mayor Benson noted that Market Street is designed to accommodate trucks. He said there is an issue for trucks turning onto Wooster Street and then trying to turn North onto State Route 21 when they see the no truck signs. Ms. Gallion said she contacted different truck companies and she said everyone was very helpful. The truck traffic has been notably reduced. She said she tried to contact Wheeling and Lake Erie Railroad regarding a quiet zone, but was unsuccessful. Lastly, she suggested having a Council of the Whole Meeting on October 17, 2022 at 6:00 pm to discuss the CDBG Grant. Mr. Cline reported the Navarre-Bethlehem Golf Scramble is this Sunday, if anyone would like to help with the event. Mr. Rouse said he will not be in attendance at the next Council Meeting. Ms. Lehman is planning to host Coffee with Council at Anderson’s and requested the event be placed on the Civic Center sign.
