Session 20 November 21, 2022
Mayor Robert Benson called the 20th Regular Session of Council to order on Monday, November 21, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Molly Lehman and Josh Smith. Also attending the meeting were Clerk-Treasurer Anne Johnson and Village Solicitor Attorney Terry Seeberger. Mr. Smith noted there was not a Street Committee Meeting tonight as planned.
Mr. Smith motioned to approve the minutes of the 19th Regular Session of Council held on November 7, 2022. Mr. Kammer seconded. Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Ms. Gallion abstained. Five yes votes. Minutes approved. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims. SOLICITOR Village Solicitor Attorney Terry Seeberger discussed the need for Ordinance 20A-2022. There were some changes made in the language which needs to be approved before sending it the County. Attorney Terry Seeberger also advised that he and Mr. Smith are reviewing the statements of qualifications from design engineers for the Waste Water Treatment Plant Expansion Project. Results should be ready for the next council meeting. Attorney Terry Seeberger reported no agreement has been made regarding the Studer/Kirby annexation. Lastly, Attorney Terry Seeberger said bids were received on Thursday for Street Paving Projects. He noted that the bids received cannot exceed the engineers estimate by ten percent per state law. MAYOR Mayor Robert Benson spoke about the aggregation information received from Buckeye Energy Brokers, Inc. and advised that all residents should be on IGS and can verify this on the billing statement they receive from Columbia Gas in December. Mayor Robert Benson advised Council Meetings in January 2023 will be held on the second and fourth Monday, January 9th and 23rd, but the remainder of the year will be as usual on the first and third Mondays of the month. ORDINANCE AND RESOLUTIONS Ordinance 20A-2022, an ordinance approving Navarre-Stark County Sewer Sanitary Sewage Service Agreement, to be passed as an emergency. Mr. Smith offered and moved to accept Ordinance 20A-2022 and declared same to be an emergency. Ms. Lehman seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried. Ordinance accepted. Ordinance 20A-2022, Mr. Smith moved, Ms. Lehman seconded rules requiring three separate readings of Ordinance 22-2022 be suspended. Motion carried. Ordinance 20A-2022 duly adopted. MISCELLANEOUS Mr. Smith requested a Street Committee Meeting for Monday, November 28, 2023 at 4:30 pm. Mr. Smith also discussed the gas aggregation program. Ms. Gallion said she is on the board for the CDBG Grant Applications. She said she plans to attend the meetings for our application. Mayor Benson noted it would be safer for trucks to be on Market Street than turning onto Wooster Street and trying to turn North onto State Route 21. Mr. Kammer would like the Village to donate $1000.00 to the Fairless Salvation Army and made a motion for same. Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried. Ms. Lehman said she needs a Letter of Commitment for a grant application of park equipment for labor and materials and it’s needed by November 30, 2023 for the project at Underwood Park. She advised she is still working on the new business guide for the Village. She reported she has confirmed a presentation from the Western Reserve Land Conservancy on January 23, 2023 at 6:30 pm. She stated she has been in contact with Stark Parks regarding protection of the trail during the waste water treatment plant expansion. Lastly, she would like to schedule another Coffee with Council to be held at Anderson’s on January 21, 2023 from 9:00 -11:00 am. Mr. Smith reported he could not find anything on the books regarding billboards. He has received calls on why the Village isn’t spending the American Rescue Plan Act money. He explained we intend to use the money for the Waste Water Treatment Plant Expansion Project, however, he said it could also be used for sidewalks and streets. Mr. Smith requested a Finance Committee Meeting for December 19, 2022 at 6:15 pm. BILLS AND CLAIMS Ms. Gallion moved to approve bills and claims in the amount of $50,981.09. Mr. Kammer seconded.
