Session 8, April 18, 2022
Mayor Robert Benson called the 8th Regular Session of Council to order on Monday, April 18, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Josh Smith and Derek Netzly. Also attending the meeting were Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger and Village resident Ron Kerby, friends and family of Michael Cvengros, Police Captain Matt Amendola and Patrolman Alec Hall.
Mr. Netzly moved to approve the minutes of the 7th Regular Session of Council held on April 4, 2022. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Minutes approved. PUBLIC PARTICIPATION Ron Kerby presented Council with a report of the truck traffic he reviewed for one day on Market Street. POLICE SAFETY Captain Matt Amendola reviewed the monthly Police Report. They are busier than they have ever been. Mayor Benson reported that Chief Shetler had a major surgery on his back and it was successful. Chief Shetler noted that Captain Amendola is doing an excellent job for the department. Chief Chad Shetler requests the appointment of Michael Cvengros to the Navarre Police Deparment Auxiliary Unit. Mayor Benson appointed Michael Cvengros to the Auxiliary Unit and requested Council’s consent. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Appointment carried. Mayor Benson administered the Oath of Office to Patrolman Michael Cvengros. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the bills and claims and the Street Committee Meeting minutes. SOLICITOR Village Solicitor Attorney Terry Seeberger noted there if there is a super majority passage of a resolution, only one reading is required per the Ohio Revised Code. Attorney Terry Seeberger will be preparing Ordinance 15-2022 for the next Council Meeting, which will be a replat of a part of Prospect Park (918-919-920). Also, he is looking into getting American Legal Publishing on hard drive rather than paying for the books. He mentioned a new business, The Smoke Shop, will be opening in the Village. They will need to submit a zoning application because the location is currently zoned residential. MAYOR Mayor Benson shared a copy of a letter from Direct Energy, who will take over our contract for Volunteer Energy, who has filed for bankruptcy. Mayor Benson advised Ordinance 11-2022 and 12-2022 will be presented at the next council meeting. Copies of the ordinances will be sent to Council members, as a fourteen-day notice is required for tax increment financing ordinances. ORDINANCE AND RESOLUTIONS Ordinance 10-2022, an ordinance amending zoning code 151.83, adding sections (F) and (G), was given a second reading by title only. Ordinance 13-2022, an ordinance regulating parking during snow emergencies, enacting Section 76.10 Regulation. Ms. Gallion offered and moved to accept Ordinance 13-2022. Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. The first reading was given. Ordinance 14-2022, an ordinance regulating parking during street sweeping, enacting Section 76.11 Regulation. Ms. Gallion offered and moved to accept Ordinance 14-2022. Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. The first reading was given. Resolution 2022-5, a resolution authoring payment of additional sums to United Earthworks App No 6R2. Mr. Netzly offered and moved to accept Resolution 2022-5. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Resolution 2022-5 accepted. Resolution 2022-6, a resolution authoring Administrator to approve change order to United Earthworks for Sterilite St. NE Extension No 3 Project. Council reviewed and discussed the change order for the Prospect Park Project. Mr. Netzly offered and moved to accept Resolution 2022-4. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Resolution 2022-4 accepted. ADMINISTRATOR Village Administrator Zachary Wisselgren is looking into a company that can send out notifications to residents for street sweeps and snow emergencies and such. The first street sweep in the Village is scheduled for April 27, 2022. Mayor Benson will post the schedule on the Village Website. Zachary Wisselgren reported the back of the feed mill is being repaired. He stated he spoke to resident Don Esway about clearing brush and trees for a better line of sight. MISCELLANEOUS Ms. Galllion asked about the road to the midget football field. Mr. Wisselgren said he has spoken to Superintendent Broc Bidlack about plans for the road and the drainage, as the school owns the property. Mr. Cline stated he received a complaint about junk on a property. Captain Amendola advised that the complaint needs to be reported to the Zoning Inspector. Mr. Cline reported the Easter Egg Hunt was a huge success. He said there was a great turnout since other egg hunts were canceled. He also stated he is moving ahead with Memorial Day plans, reporting a speaker has been secured. Mr. Netzly measured the dumpsters and believes there is room to move them along the tree line. He feels we should remove the Planet Aid box, as people leave items there. BILLS AND CLAIMS Mr. Netzly moved to approve bills and claims in the amount of $45,385.50. Mr. Smith seconded.
