Session 11, June 6, 2022
Mayor Robert Benson called the 11th Regular Session of Council to order on Monday, June 6, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Josh Smith and Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Administrator Zachary Wisselgren, Village Solicitor Attorney Terry Seeberger and Village residents Betty Flick, Carol Goodnight and Alaina Rouse.

Mr. Netzly moved to approve the minutes of the 10th Regular Session of Council held on May 16, 2022. Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Minutes approved.

PUBLIC PARTICIPATION
Resident Carol Goonight reported her and her neighbors on Fohl Road are concerned about the TSC traffic. Mayor Benson stated their truck traffic is not supposed to come into the Village. Mr. Smith advised signage will be installed to direct the truck traffic. Carol Goodnight also asked about the condition of the road going into the Navarre-Bethlehem Park. Zachary Wisselgren reported the road is scheduled to be paved.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the May financial statements and the bills and claims.


SOLICITOR
Village Solicitor Attorney Terry Seeberger noted that Ordinance 11A-2022 replaces ordinance 11-2022 passed a few weeks ago. This TIF will help to fund the Waste Water Treatment Plant improvements and expansion. Attorney Seeberger stated he received part of a proposal from the Sanitary Engineer’s Office for the expansion of the Waste Water Treatment Plant.

MAYOR
Mayor Robert Benson noted that the fourth of July falls on a Council Meeting night. Mr. Netzly suggested just having one meeting in July on the eighteenth. Mayor Benson said Mr. Cline did a fantastic job on the Memorial Day Program. Mr. Netzly reported receiving complaints that the marching band was not in the parade. Mayor Benson and Council agree that a note should be sent to the Fairless Marching Band to thank them for participating in the service.

Mayor Benson recommended Buckeye Brokers to replace Volunteer Energy. Resolution 2022-8 will authorize the Village to enter into a gas aggregation contract with the new supplier. Mayor Benson requested Council’s consent to renew PUCO, the natural gas certification renewal. Mr. Netzly motioned to give consent and Mr. Cline seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried.

ADMINISTRATOR
Village Administrator Zachary Wisselgren reported the sewer line at Village Hall is not fixable. The plan is to bore to the front of the Post Office, with their permission. Mr. Wisselgren said eighty-eight and a half tons of street sweepings were taken to the landfill. He advised he is working on a new storm sewer plan for the EPA. The gazebo at Underwood Park was damaged. The camera did catch the kids involved and they will have to pay restitution. Mr. Wisselgren said notification cards have been ordered for the REACH Alert, street sweepings and snow parking ban. Mr. Wisselgren stated water and sewer rates will need to be adjusted for the increased operating costs. Work is set to begin on water well #2. Sidewalk work will be done on trouble spots at a cost of $40-$45 to residents for material.


ORDINANCE AND RESOLUTIONS
Ordinance 11A-2022, an ordinance establishing Mid’s Pasta Sauce Non-Joint Fire District TIF, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 11A-2022 and declared same to be an emergency. Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Ordinance accepted.

Ordinance 15-2022, an ordinance approving re-plat of out lot 914, creating outlet 918 and 919, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 15-2022 and declared same to be an emergency. Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Ordinance accepted.

MISCELLANEOUS
Ms. Gallion said she received a complaint about a house located at Tuscarawas and Canal Streets. Mayor Benson said a letter is to be sent out from the Zoning Inspector.

Mr. Cline gave thanks to everyone who helped with the Memorial Day Parade. Mayor Benson said his son would like to sing at the service next year, as it will be Mayor Benson’s last year. Mayor Benson inquired about the flags and Mr. Wisselgren advised he is looking into it.

Mr. Rouse reported the Pepsi machines at the Parks have been fixed.


BILLS AND CLAIMS
Mr. Smith moved to approve bills and claims in the amount of $216,759.80. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Bills and claims approved.
