Session 6, March 21, 2022
Mayor Robert Benson called the 6th Regular Session of Council to order on Monday, March 21, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Josh Smith via Zoom and Derek Netzly. Also attending the meeting were Village Administrator Zachary Wisselgren, Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Bethlehem Township Trustee Renee Veselenak and Village residents Danny Agnes, Bill Campbell, James Gray, Dave Gorley, Ron Kirby, Robert Ludwig and Dolores Schmidt.
Mr. Netzly moved to approve the minutes of the 5th Regular Session of Council held on March 7, 2022. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Minutes approved. PUBLIC PARTICIPATION Ron Kirby presented Council with a petition signed by forty residents that live on Market Street who are opposed to Market Street being designated as a truck route, as it is a residential neighborhood. Trucks need to stay on state routes. James Gray noted that truck traffic is only going to get worse with businesses at Prospect Park. Attorney Terry Seeberger said he looked into weight limits for Market Street, but that would be a County decision. Attorney Terry Seeberger advised he will look into creating an ordinance limiting truck traffic on Market Street. There was a discussion about truck traffic coming out of Prospect Park. Mr. Smith stated he will speak with the County Engineer about this. Bethlehem Township Trustee Renee Veselenak reported that Bethlehem Township passed a resolution tonight to have an Ecycle Box placed in the Navarre-Bethlehem Park, it will be for batteries and electronics. Ecycle will pay us and the generated funds could be used to get an all-weather system for the enclosed pavilion at the park so that it could be rented out year-round. Mr. Netzly motioned, Ms. Gallion seconded to place an Ecycle Box in the Navarre-Bethlehem Park. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. SAFETY POLICE The February Police Report was distributed to Council. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims. ORDINANCE AND RESOLUTIONS Ordinance 6A-2022, an ordinance correcting pay amounts for the Water and Wastewater Superintendents, to be passed as an emergency. Mr. Netzly offered and moved to accept Ordinance 6A-2022 and declared same to be an emergency. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Ordinance accepted. Ordinance 6A-2022, Ms. Gallion moved, Mr. Cline seconded rules requiring three separate readings of Ordinance 6A-2022 be suspended. Motion carried. Ordinance 6A-2022 duly adopted. Ordinance 8-2022, an ordinance approving the replat of lots of Kenneth Diehl and Mickie Diehl, was given a second reading by title only. Ordinance 9-2022, an ordinance granting Falcon Baseball and Softball priority use of baseball fields, to be passed as an emergency. Motion carried. Ordinance 9-2022 duly adopted. SOLICITOR Village Solicitor Attorney Terry Seeberger said he will have a proposed amendment to the Zoning Code for the April 4, 2022 Council Meeting. The amendment to the Zoning Code will put the responsibility of ensuring the recording has occurred on the zoning appellant. There will be a Public Hearing next Monday with the Zoning Board of Appeals regarding the Mid’s zoning variance. MAYOR Mayor Robert Benson reported he was contacted by Jim Stanford regarding asphalt work that was recently completed at the YMCA for $5000.00. Mr. Stanford inquired to see if the Village would contribute to the cost. Mr. Netzly motioned to pay $2500.00 of said asphalt work, Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. Mayor Benson mentioned the Memorial Day Parade is approaching on May 30, 2022. He requested a couple Council Members organize the parade. He suggested working with the VFW to get a guest speaker. Mr. Cline and Mr. Netzly agreed to organize the event. A program will need to be prepared for the event. ADMINISTRATOR Village Administrator Zachary Wisselgren reported a new cast catch basin will be installed behind Village Hall. The annual Storm Water Report is due by April 1, 2022. New signs have been installed on Canal Street. Also, he suggested we could vacate Meyers Alley for Nickles Bakery. MISCELLANEOUS Mr. Kammer asked if there are any plans to move the recycle bins. Mayor Benson responded there is nothing planned at this time. Mr. Netzly suggested installing privacy fence and commented that the recycle bins serve the community. Mr. Smith said he will talk to the County Engineer regarding truck traffic and advised there is a Street Committee Meeting set for April 4, 2022 at 6:30pm. Mr. Netzly gave thanks to Attorney Seeberger for putting together the zoning presentation. He questioned if the camera works behind Village Hall.
