Session 10, May 16, 2022
Mayor Robert Benson called the 10th Regular Session of Council to order on Monday, May 16, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Josh Smith and Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Administrator Zachary Wisselgren, Village Solicitor Attorney Terry Seeberger, Police Captain Matt Amendola and Village residents Bill Campbell and Ron Kerby.
Mr. Smith moved to approve the minutes of the 9th Regular Session of Council held on May 2, 2022. Mr. Kammer seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Minutes approved. PUBLIC PARTICIPATION Resident Ron Kerby asked about the truck traffic situation on Market Street. Mr. Smith stated that signs will be put up as well as with the Prospect Park traffic. Village Solicitor Attorney Terry Seeberger advised he is preparing an ordinance to prohibit thru truck traffic on Market Street. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims. SOLICITOR Village Solicitor Attorney Terry Seeberger noted that Ordinance 11A-2022 for a tax increment finance will be presented at the June 6, 2022 Council Meeting. The school board notice needed to be sent prior to passing the ordinance. Attorney Seeberger spoke with Stark County Commissioner Bill Smith about the Waste Water Treatment Plant Expansion Project. A cooperation agreement is coming soon from the Stark County Sanitary Engineer’s Attorney. MAYOR Mayor Robert Benson shared letters he received from Kristy Werstler, Jamie and Ray Foundriest and Terry from The Hair Emporium. Steve Morelli contacted Mayor Benson about a tombstone being knocked over near his house. Mayor Benson would like to have the records of Union Lawn Cemetery placed on a computer rather than just the paper form. ADMINISTRATOR Village Administrator Zachary Wisselgren said our Engineer, Don Dummermuth, should have the Canal Street paving plans ready to go in two weeks. The street signs have been received for the corporation limits and for no thru trucks on Market Street. Crack sealing on the streets will be done in June. Administrator Zachary Wisselgren reported he will be ordering cards to send to residents about the street sweeping ordinance and the new text alert program that residents can sign up for. Mayor Benson asked about the sewer situation at Village Hall. The employees are unable to use the restrooms. Mr. Netzly inquired about helping residents get their sidewalks repaired. ORDINANCE AND RESOLUTIONS Ordinance 13-2022, an ordinance regulating parking during snow emergencies, enacting Section 76.10 Regulation, was given a third and final reading. Mr. Smith offered, Mr. Netzly seconded Ordinance 13-2022 be placed in final passage. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Ordinance 13-2022 declared duly adopted. Ordinance 14-2022, an ordinance regulating parking during street sweeping, enacting Section 76.11 Regulation, was given a third and final reading. Mr. Smith offered, Mr. Cline seconded Ordinance 14-2022 be placed in final passage. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Ordinance 14-2022 declared duly adopted. Resolution 2022-7, a resolution authoring Administrator and Mayor to take necessary actions to participate in Opioid litigation. Mr. Netzly offered and moved to accept Resolution 2022-7. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Resolution 2022-7 accepted. MISCELLANEOUS Ms. Gallion said a resident asked about starting a business in their home. She was informed some properties have deed restrictions. Mr. Kammer reported he has received complaints about people not mowing their grass. Mr. Cline advised he received a complaint about a house on Canal Street. Mayor Benson reported a letter has been sent to the homeowner. Mr. Rouse wanted to discuss parking during the Garage Sales. Mr. Netzly distributed the minutes from the last Council of the Whole Meeting. It was determined that no action would be taken at this time regarding the Navarre-Bethlehem Park Project. Mr. Netzly motioned. Ms. Gallion seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes. Motion carried. BILLS AND CLAIMS Mr. Smith moved to approve bills and claims in the amount of $54,626.79. Mr. Netzly seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Smith yes, Netzly yes. Six yes votes.
