Session 16, September 19, 2022
Mayor Robert Benson called the 16th Regular Session of Council to order on Monday, September 19, 2022. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. This public meeting is being recorded. Members answering roll call were Abby Gallion, Joseph Kammer, Justin Cline, Daniel Rouse, Molly Lehman and Josh Smith. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Solicitor Attorney Terry Seeberger, Zoning Inspector James Neely, Police Chief Chad Shetler, Captain Matthew Amendola, Detective Daniel Kirby and wife Sue Kirby, Daniel Yeager and residents Bruce Hostetler, Don Esway, Ron Kerby and James Grey.
Ms. Gallion motioned to approve the minutes of the 15th Regular Session of Council held on August 15, 2022. Ms. Lehman seconded. Gallion yes, Kammer yes, Cline yes, Lehman yes, Smith yes. Rouse abstained. Five yes votes. Minutes approved. PUBLIC PARTICIPATION Ron Kerby advised he is still concerned about the truck traffic on Market Street. He feels the signage is in poor locations. Ms. Gallion said she will contact the companies to let them know there is no thru trucks permitted on Market Street. Ms. Gallion also suggested letters be sent to the truck companies. Don Esway said he thinks Trick-or-Treat should not be held on Thursday nights. Mayor Benson noted that Kiwanis used to meet on Thursdays and assist with Trick-or-Treat. Also, the YMCA holds a community event immediately following Trick-or-Treat. Mr. Esway also said better signage is needed where the lane ends on State Route 21, by the old water tower. He said there will be additional traffic when the TSC warehouse opens. POLICE SAFETY Police Chief Chad Shetler reviewed the monthly police report. He shared the quotes from Seifert Technologies for the tower server for the police department. Mr. Smith motioned and Mr. Kammer seconded to move forward with the purchase. Mr. Smith reported the Finance Committee received a budget from the police department for next year. Police Chief Chad Shetler said the police department needs a different email system thru Microsoft 365 and Seifert Technologies for police reports. Ms. Gallion motioned to proceed with Seifert Technologies for the email system. Mr. Rouse seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried. Mr. Smith motioned and Ms. Lehman seconded the police department stay with the Marcs Radio System. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried. Chief Chad Shetler discussed truck traffic on Market Street. He advised he is more concerned with trucks turning onto Main Street from Wooster Street. He also discussed potential TSC traffic. Chief Chad Shetler said Daniel Yeager, who was previously employed with the Navarre Police Department would like to return to the department on a part-time basis. Chief Shetler requested Council’s consent. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Consent was given. Mayor Benson appointed Daniel Yeager to the Navarre Police Department and swore him in. Chief Chad Shetler requested the promotion of Daniel Kirby from detective to sergeant. Mayor Benson appointed Daniel Kirby as Sergeant of the Navarre Police Department. FINANCE Clerk-Treasurer Anne Johnson gave council a copy of the September financial statements, today’s check register, the bills and claims and the Alternative Tax Budget that was sent to the County. She reported the Village of Brewster is holding an Ethics Law Training Course on November 3, 2022 at 10:00 am. SOLICITOR Village Solicitor Attorney Terry Seeberger said Ordinance 20-2022 is a significant step to putting pressure on the County for the eight-million-dollar Waste Water Project. Terry Seeberger advised we will wait to take action on this ordinance, as Mr. Smith and Village Administrator Zachary Wisselgren have some concerns. Attorney Terry Seeberger reported Resolution 2022-11 is needed due to the cost of the Waste Water Plant Expansion Project, as it is a statutory requirement. ZONING Village Zoning Inspector Jim Neely reported a property owner on Ohio Street has been a problem for twenty years. Most recently, the property owner brought in fill dirt on the flood plain. Jim Neely stated it is time to take legal action and declare the property a public health nuisance. Mr. Kammer motioned to approve and Mr. Smith seconded. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Motion carried. MAYOR Mayor Benson suggested a donation be made to the Fairless Food Cupboard for their annual toy drive. A decision was made to donate $1500.00 to the Fairless Food Cupboard for the annual toy drive. Ms. Gallion motioned to approve the donation and Mr. Kammer seconded. Mayor Benson presented a Proclamation stating appreciation for fifty years of service to the community by the Navarre-Bethlehem Township Historical Society that was which was presented to the Historical Society at an appreciation event held on Saturday, September 10, 2022. Mayor Benson congratulated the Historical Society. ORDINANCE AND RESOLUTIONS Ordinance 18-2022, an ordinance amending sec. 112.01 and repealing sec 112.02-112.06 regarding door-to-door solicitation, was given a third and final reading. Mr. Smith offered, Mr. Kammer seconded Ordinance 18-2022 be placed in final passage. Gallion yes, Kammer yes, Cline yes, Rouse yes, Lehman yes, Smith yes. Six yes votes. Ordinance 18-2022 declared duly adopted. Ordinance 19-2022, an ordinance enacting new section 10.20 regulation regarding repeat violations of maintenance regulation, was given a second reading by title only. Resolution 2022-10, a resolution authoring signature for WPCLF/WSRLS Loan Fund Compliance Certification. Mr. Smith offered and moved to accept Resolution 2022-10. Ms. Gallion seconded. Resolution 2022-11, a resolution for request for qualifications for professional design and engineering. Mr. Smith offered and moved to accept Resolution 2022-11. Ms. Gallion seconded. MISCELLANEOUS Ms. Gallion said the solicitation signs in the Village will need to be taken down. She also said she went to the Regional Planning Commission Meeting and she will look into grant applications that could be used to benefit the community. Mr. Cline reported he is receiving complaints about dirt bikes in town. He also mentioned there will be a Golf Outing at Bethlehem Park on October 9, 2022 to raise money for a scholarship available to a Fairless student. Mr. Rouse asked about the Smoke Shop. The building has been empty for two years. The Smoke Shop had to appeal for a variance, which was approved. Ms. Lehman stated she needs a copy of the House Rules.
