Session 18, September 17, 2018
Mayor Robert Benson called the 18th Regular Session of Council to order on Monday, September 17, 2018. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Derek Netzly, Daniel Rouse, Randy Hattery, Don Berkey and Pat Winkhart. Robin Keith was excused from the meeting. Also attending the meeting were Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Navarre Village Prosecutor G. Ian Crawford, Navarre Police Chief Dennis Albaugh, Zoning Inspector Jim Neely, Independent Reporter Arezov Vakili, Bill Burtt, Pat Rhodes and Hunter Rouse.

Ms. Winkhart moved to approve the minutes of the 17th Regular Session of Council held on September 4, 2018. Mr. Netzly seconded. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Minutes approved.

Mr. Netzly moved to approve the minutes of the Special Session of Council held on September 10, 2018. Mr. Berkey seconded. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Minutes approved.

PUBLIC PARTICIPATION
Day Avenue residents, Bill Burtt and Pat Rhodes presented an agreement for the Village owned property on Day Avenue. Mr. Netzly expressed concerns about hunting on that property and he would like council to discuss further. Mr. Netzly also suggested putting the property up for auction.

SAFETY POLICE
Police Chief Dennis Albaugh distributed the monthly report.

Police Chief Dennis Albaugh reported Drug Take Back Day is this Saturday from 10am-2pm at the YMCA.

Police Chief Dennis Albaugh reported the police department is currently working on a grant for body cameras.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register and the bills and claims.

SOLICITOR
Village Solicitor Attorney Terry Seeberger reported that the AT&T lawsuit has been filed.

Attorney Terry Seeberger also reported the engineer has certified substantial completion of the water projects effective June 30, 2018. There are some change orders and a conference is scheduled for next week to discuss. The project is coming in under budget.

ORDINANCE AND RESOLUTIONS
Ordinance 16-2018, an ordinance for the 2019 Tax Budget. Mr. Netzly motioned, Ms. Winkhart seconded Ordinance 16-2018 be place in final passage. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Ordinance 16-2018 declared duly adopted.

Ordinance 18-2018, an ordinance amending Ordinance 16-2017 adding a stipend for certified welders, to be passed as an emergency. Ms. Winkhart offered and moved to accept Ordinance 18-2018 and declared same to be an emergency. Mr. Netzly seconded. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Motion carried. Ordinance accepted.
Ordinance 18-2018, Mr. Berkey moved, Mr. Rouse seconded rules requiring three separate readings of Ordinance 16-2018 be suspended. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Rules requiring three separate readings suspended.

Ordinance 18-2018, Ms. Winkhart moved, Mr. Berkey seconded Ordinance 18-2018 be placed in final passage. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Ordinance 18-2018 duly adopted.

Resolution 2018-11, a resolution authorizing payment to a certified welder from August 27, 2018 to the passage of Ordinance 18-2018. Ms. Winkhart moved, Mr. Berkey seconded to accept Resolution 2018-11. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Resolution 2018-11 accepted.

MAYOR
Mayor Benson signed the agreement that G. Ian Crawford proposed for 2019. There were no significant changes from the current agreement.

Mayor Benson reported that Jason Pumneo of the Fairless Youth Football Association sent a note stating the Association appreciates the work the Village does for them, by mowing the football field.

Mayor Benson advised the Village has always made a donation to the Fairless Food Cupboard Annual Toy Drive in the past. Mr. Netzly motioned to donate $1000.00 for the Toy Drive. Ms. Winkhart seconded. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Motion carried.

MISCELLANEOUS
Mr. Netzly questioned plans for the old water tower. Mayor Benson reported no plans at this time.

Mr. Rouse reported the Property Maintenance Committee met prior to the council meeting and that notices will be sent out to several property owners.

Ms. Winkhart advised if the buyer’s agent, Diane Chaplin, gets a response from our offer, we can schedule a Special Meeting.

Mayor Benson reported that Music in the Park was really nice.

Ms. Winkhart noted the Miles that Matter 5K at the YMCA is scheduled for September 29, 2018.

G. Ian Crawford reported there is a movement in Massillon Municipal Court to turn the old Massillon Jail into a subdivision of the Stark County Jail.

BILLS AND CLAIMS
Mr. Netzly moved to approve bills and claims in the amount of $452,845.26. Mr. Berkey seconded. Netzly yes, Rouse yes, Hattery yes, Berkey yes, Winkhart yes. Five yes votes. Bills and claims approved.
