Session 11, June 4, 2018

Mayor Robert Benson called the 11th Regular Session of Council to order on Monday, June 4, 2018.  Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance.  Members answering roll call were Derek Netzly, Robin Keith, Randy Hattery, Don Berkey and Pat Winkhart.  Daniel Rouse was excused.  Also attending the meeting were Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Navarre Police Chief Dennis Albaugh, friends and family of Officer David Bertman, Officer Elizabeth Hughey and Officer Adam Weese, Erie Valley Fire and Rescue Chief Rick Annen, Village Zoning Inspector Jim Neely, Independent Reporter Arezov Vakili, Kimble Account Manager Julie Monroy, Chris Miller of Miller’s Refuse, Jessica Bender, Sabrina Hattery and Joe Skirtich. 

Mr. Netzly moved to approve the minutes of the 10th Regular Session of Council held on May 21, 2018.  Ms. Winkhart seconded.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Five yes votes.  Minutes approved.

PUBLIC PARTICIPATION

Jessica Bender apologized to Council.  She stated she was unaware of the zoning process for her daycare operation.  She said she is in the process of getting a license through the county.  Attorney Terry Seeberger explained that she will have to go through the Zoning Board of Appeals to get a Use Variance Permit to operate in a residential area.

SAFETY POLICE

Chief Dennis Albaugh distributed and reviewed the monthly report to council.  Curfew for persons under 18 is 10:00 pm.  Coffee with a Cop will meet tomorrow with Officer Matt Amendola at 6:00 pm at Anderson’s Coffee Shop.

 Chief Dennis Albaugh introduced David Bertman, Elizabeth Hughey and Adam Weese to Council.  Chief Dennis Albaugh requested the appointment of Patrolman David Bertman to the Navarre Police Department full-time.  Mayor Benson appointment Patrolman David Bertman to the Navarre Police Department full-time and requested Council’s consent.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  

Five yes votes.  Appointment carried. 

Chief Dennis Albaugh also requested the appointment of Patrolman Elizabeth Hughey to the Auxiliary Unit of Navarre Police Department.  Mayor Benson appointed Patrolman Elizabeth Hughey to the Navarre Auxiliary Unit and requested Council’s consent.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Five yes votes.  Appointment carried.

Chief Dennis Albaugh also requested the appointment of Patrolman Adam Weese to the Auxiliary Unit of Navarre Police Department.  Mayor Benson appointed Patrolman Adam Weese to the Navarre Auxiliary Unit and requested Council’s consent.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Five yes votes.  Appointment carried

The Mayor swore in the three patrolmen with the Oath of Office.

FINANCE

Clerk-Treasurer Anne Johnson gave council her May financial statements and a copy of today’s check register.

ORDINANCES AND RESOLUTIONS

Ordinance 9-2018, an ordinance adopting and enacting 2018 Ohio Basic Code.  Ms. Winkhart moved to accept Ordinance 9-2018.  Ms. Keith seconded.  Netzly yes, Keith yes, Hattery yes, Berkey nay, Winkhart yes.  Five yes votes.  Motion carried.  The first reading was given. 

SOLICITOR

Attorney Terry Seeberger reported that only one bid was received for the Village garbage and rubbish collection, along with an alternate bid.  Attorney Seeberger requested Council wait until the next council meeting to take action so further study can be done on what course of action to take.  Ms. Winkhart motioned to post-pone action until the June 18th council meeting.  Mr. Hattery seconded.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Five yes votes.  Motion carried.

Attorney Terry Seeberger also reported that the Water Treatment Plant is about two weeks away from substantial completion.  There is an outstanding change order for $14,518.00.  The contract states we can access liquidated damages for each day over schedule.  We are negotiating with the contractor.

MAYOR

Mayor Benson distributed information on the Sprint Mini Macro project, a small tower to be placed on the Fire Department roof at the civic center.

MISCELLANEOUS

Mr. Netzly gave thanks to the employees, VFW, Police Department and Fire Department for helping with the Memorial Day activities.

Ms. Keith reported that Mr. Lint is very pleased with the work done on his alley.

Ms. Keith advised she has received numerous calls regarding the Fire Department’s property purchase.

Mr. Hattery reported that business owners are concerned with outside vendors coming into town during VONBA special events.  Attorney Terry Seeberger stated he will look at Canton’s ordinance and prepare an ordinance for the Village, charging a fee for licensing.

Mr. Berkey questioned what can be done about residents who leave their garbage cans sitting by the street?  Mayor Benson said we could send them a letter.

Ms. Winkhart gave thanks to Scott Baker and Jim Urbach for their work on Memorial Day, along with Pat Burley.

Ms. Winkhart attended a meeting with Stark County Community Action about options for people to get jobs.  She suggested we could create a program for our community for job opportunities.

Joe Skirtich suggested that if we ever need a name for a street or an alley, that the name Cincinat should be considered.

BILLS AND CLAIMS

Ms. Keith moved to approve bills and claims in the amount of $149,229.24.  Mr. Hattery seconded.  Netzly yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Five yes votes.  Bills and claims approved.
