Session 7. April 2, 2018

 Mayor Robert Benson called the 7th Regular Session of Council to order on Monday, April 2, 2018.  Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance.  Members answering roll call were Derek Netzly, Daniel Rouse, Robin Keith, Randy Hattery, Don Berkey and Pat Winkhart.  Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Administrator Zack Wisselgren, Navarre Village Solicitor Attorney Terry Seeberger, Navarre Police Department Captain Jason Fisher, Mike Piergask, Vicki Owen-Merry of Navarre-Bethlehem Park Board.  Mr.  Netzly moved to approve the minutes of the 6th Regular Session of Council held on March 19, 2018.  Mrs. Winkhart seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Minutes approved.  Mr. Netzly moved to approve the minutes of the Special Session held on March 23, 2018.  Ms. Winkhart seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Minutes approved.

 SAFETY POLICE

Navarre Police Captain Jason Fisher distributed the monthly report to Council.  Captain Fisher reviewed the monthly police report and reviewed the speed sign report results.

 FINANCE

Clerk-Treasurer Anne Johnson distributed the March financial statements and a copy of today’s check register.

 SOLICITOR

Village Solicitor Attorney Terry Seeberger advised the Navarre-Bethlehem Park annexation process will be completed soon so the police can patrol the park.

Attorney Terry Seeberger reported the Fire District is involved in a series of transactions involving a re-plat deed for the triangle and an alley vacation for their expansion project.

Attorney Terry Seeberger stated there will be a public hearing by the Planning Commission on April 24, 2018 regarding an application for a license to operate.

ORDINANCES AND RESOLUTIONS

Ordinance 4-2018, an ordinance establishing water service rates was given a third and final reading.  Ms. Winkhart offered and moved to accept Ordinance 4-2018.  Ms. Keith seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Ordinance 4-2018 duly adopted. 

Ordinance 7-2018, an ordinance authorizing the Village Administrator to advertise for bids for the collection of Village residential trash for a three year period, was given a second reading by title only.

MAYOR

Mayor Robert Benson reported that Zach Wisselgren has performed the duties of acting Navarre Village Administrator above and beyond expectation.  Mayor Benson requested Councils consent to allow him to appoint Mr. Wisselgren as Navarre Village Administrator.  Ms. Keith motioned.  Mr. Berkey seconded consent to appoint Navarre Village Administrator.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.  Mayor Benson appointed Zach Wisselgren as Navarre Village Administrator.

Mayor Benson advised that Ordinance 18-2017, Section 96.05 states two Navarre-Bethlehem Navarre representatives, together with a third member to be appointed by Council shall constitute the Navarre Park Board.  Mayor Benson requested Council consider the appointment of Edward Whitmore to the Navarre Park Board.  Ms. Keith motioned to appoint Edward Whitmore to the Navarre Park Board.  Mr. Berkey seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.  Edward Whitmore appointed to Navarre Park Board.

Mayor Benson stated the Navarre Baseball and Softball Association requests permission to place Home Run Fence on Gully Ballfield #2.  Ms. Winkhart motioned.  Mr. Netzly seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.

STREETS AND ALLEYS

The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm and weekends and holidays from 8:30 am to 11am.

A quote was received for paving streets.  The Administrator reviewed the proposal with council and gave his recommendation.  Ms. Winkhart motioned.  Mr. Hattery seconded to accept the Administrator’s recommendation.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.

The Street Department will be changing out the banners this week when the weather cooperates.  The Street Department needs a garage sale banner. 

Village clean-up day is scheduled for April 21, 2018 and will be advertised.

UTILITIES

The Sewer Department is checking for infiltration in the trunk line.  The infiltration is using up needed capacity to add Prospect park to our sewer system.

Hydrant flushing will be April 24 -26.  Two fire hydrants were repaired.

Bogner Construction is asking for an extension for project completion at the Water Treatment Plant.  They had trouble with roofing materials, among other things, and will be discussed at the construction meeting.

MISCELLANEOUS

Vicky Owen-Merry updated Council regarding the work going on at Navarre-Bethlehem Park.  Some extra work is being done by Marcelli’s for reseeding, removing a stump and putting a bench back in.  Mr. Netzly motioned.  Mr. Hattery seconded to accept the additional cost of $525.00 to Marcelli’s.  Netzly yes, Rouse, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.

Mr. Hattery motioned to halt cutting wood in the Navarre-Bethlehem Park.  Ms. Keith seconded.  Netzly yes, Rouse, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Motion carried.

Vicky Owen-Merry reported the floors need power-washed to remove mud in the closed pavilion at Navarre-Bethlehem Park.

Vicky Owen-Merry advised they are working on bid packets for mowing at the Navarre-Bethlehem Park.

Mr. Hattery reported the bridge in the Gulley Park needs replaced, as it is washed out.

Mr. Netzly stated that street sign poles need painted.

Ms. Keith reported the Tree Committee met prior to the Council meeting and updated the list of trees to come down.  She advised they are also looking at replacement trees.

Mr. Hattery advised he received a complaint from John Emmert regarding parking in front of his store on the weekends.

Mr. Hattery reported trash, litter and broken glass in from of the Canal Street Pub.

BILLS AND CLAIMS

Mr. Netzly moved to approve bills and claims in the amount of $95,331.69.  Ms. Keith seconded.  Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes.  Six yes votes.  Bills and claims approved.
