Session 13, July 2, 2018
Mayor Robert Benson called the 13th Regular Session of Council to order on Monday, July 2, 2018. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Derek Netzly, Daniel Rouse, Robin Keith, Randy Hattery, Don Berkey and Pat Winkhart. Also attending the meeting were Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Erie Valley Fire and Rescue Lieutenant Shyloah Rogers, Erie Valley Fire and Rescue EMT Colin Trout, Village Zoning Inspector Jim Neely, Independent Reporter Arezov Vakili and Jeannie Swafford.

Ms. Keith moved to approve the minutes of the 12th Regular Session of Council held on June 18, 2018. Ms. Winkhart seconded. Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Netzly abstained. Five yes votes. Minutes approved.

FINANCE
Clerk-Treasurer Anne Johnson gave council her June financial statements and a copy of today’s check register.

SOLICITOR
Village Solicitor Attorney Terry Seeberger explained the changes and additions made to Ordinance 10-2018, an ordinance regulating itinerant retailers. Council discussed other scenarios, such as Art Fest and Touch-A-Truck.

Attorney Terry Seeberger advised he worked with Village Administrator Zachary Wisselgren on the specifications of Ordinance 13-2018, an ordinance authorizing Village Administrator to advertise and receive bids for collection of residential trash. Attorney Seeberger reported the village will be seeking bids for exclusive franchising for residential service. The winning contractor will be responsible to bill the residents.

Ms. Keith expressed concern for the residents who have paid in advance for their current trash service.

MAYOR
Mayor Benson reported that Nancy Berkey resigned as a member on the Navarre Bethlehem Township Community Park Board. Councilman Rouse was appointed by the Mayor as a council representative. Council will appoint a replacement for Ms. Berkey for the Navarre Bethlehem Community Park Board. The Navarre Bethlehem Community Park Board members request the appointment of Liz Urbach as Navarre resident representative. Mr. Rouse moved, Ms. Keith seconded. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Motion carried.

Mayor Benson advised that Volunteer Energy can do two options:
1) One year at 3% off the Columbia Gas adder rate.
2) Two years at NYMEX plus $.116/Ccf. That is a 5.7% discount from the Columbia Gas adder rate, rounded up as 6%.
Mayor Benson said he needs council’s permission to sign an agreement for October 1, 2018 through September 30, 2020 which will be addressed in Resolution 2018-5.


ORDINANCES AND RESOLUTIONS
Resolution 2018-5, a resolution authorizing the Village Mayor to renew the governmental aggregation program agreement with Volunteer Energy Services. Mr. Netzly moved, Ms. Winkhart seconded to accept Resolution 2018-5. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Resolution 2018-5 accepted.

Ordinance 9-2018, an ordinance adopting and enacting 2018 Ohio Basic Code, was given a third and final reading. Mr. Berkey offered, Ms. Winkhart seconded Ordinance 9-2018 be placed in final passage. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Ordinance 9-2018 duly adopted.

Ordinance 10-2018, an ordinance regulating itinerant retailers and creating Municipal Regulations 112.14, 112.15 and 112.16 was amended from first reading and given a second reading. Mr. Hattery moved to accept Ordinance 10-2018. Ms. Keith seconded. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Motion carried. The second reading was given.

Six yes votes. Motion carried. Ordinance accepted.

STREETS AND ALLEYS
The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm and weekends and holidays from 8:30 am to 11am.

Street sign posts have been painted.

The Road Maintenances Agreement is still being worked out with the County Engineer.

UTILITIES
Parts have been received for the clarifiers at the Waste Water Treatment Plant.

The CCR reports were mailed out last week as required by the Environmental Protection Agency.

The Water Treatment Plant is still behind schedule for completion date. Village Administrator Zachary Wisselgren spoke to council about negotiating with Bogner Construction. He advised the next construction meeting is Thursday, July 5, 2018.

MISCELLANEOUS
The next mosquito spraying is July 3, 2018.

A combination lock will be put in place to control the lights/electricity in the open pavilion at Navarre Bethlehem Community Park.

Ms. Keith reported the Building and Land Committee met prior to the council meeting tonight and that they are going to contact Reliable to get a free estimate for the A/C at Village Hall and the Civic Center.

Mr. Netzly reported receiving complaints regarding Bender Street.

Ms. Winkhart advised the alley by her house needs attention.

Jeannie Swafford stated Plainmont Street needs paved.

BILLS AND CLAIMS
Mr. Netzly moved to approve bills and claims in the amount of $164,714.48. Ms. Keith seconded. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Bills and claims approved.
