Session 17, September 4, 2018
Mayor Robert Benson called the 17th Regular Session of Council to order on Tuesday, September 4, 2018. Council of the Whole met at 6:00 pm, prior to the Council Meeting. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Derek Netzly, Daniel Rouse, Robin Keith, Randy Hattery, Don Berkey and Pat Winkhart. Also attending the meeting were Clerk-Treasurer Anne Johnson, Navarre Village Solicitor Attorney Terry Seeberger, Village Administrator Zachary Wisselgren, Navarre Police Chief Dennis Albaugh, Zoning Inspector Jim Neely, Vicki Owen-Merry of the Navarre-Bethlehem Park Board, Independent Reporter Arezov Vakili, Kimble Representatives Julie Monroy, David Justus and David Neff, Chris Miller of Miller Bailey Waste and his attorney Edmond Mack, and residents Nancy Berkey, Erin Billman, Carolyn Border, Carla Carl, Don Esway, Nancy Esway, Sabrina Hattery, Sarah Hutchison, Kevin Keith, Don Lint, Betty Lint, Ruth Mohr, Mark Reti, RJ Thompson, Chris Yant and Jean Swafford.

Mr. Netzly moved to approve the minutes of the 16th Regular Session of Council held on August 20, 2018. Ms. Winkhart seconded. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Minutes approved.

Vicki Owen-Merry of the Navarre-Bethlehem Park Board wishes to thank the Village employees and council members, the township employees and board members for their help at the park. The movie night went well. Music in the Park is scheduled for September 8, 2018 from 4-7pm. The closed pavilion has been painted along with the signs in the park. A golf scramble is planned on October 14, 2018 at the Elms Country Club.

PUBLIC PARTICIPATION
Many residents in attendance spoke in opposition of using Kimble as the exclusive trash carrier. They want to be able to choose their own trash service. They do not like the fact that they could not opt out.

Attorney Edmund Mack distributed deliberation materials to council. He noted that Lawrence Township and Canton Township rejected bids for an exclusive hauler, noting that residents wanted to choose their own hauler. Massillon has Kimble as their preferred, but not exclusive company for the collection of waste and recycling. Massillon also requires haulers to be licensed by the city. There is no data to prove an exclusive trash carrier will help the streets last longer. Kimble does not accept responsibility for damage to above ground utility lines. It was also noted in Kimble’s bid specs that any increase in solid waste district fees would be passed through to the Village. He requested council to consider preserving your tax payer’s choices.

Julie Monroy from Kimble stated they would work with the Village and the customers with any low wire issues.

FINANCE
Clerk-Treasurer Anne Johnson gave council a copy of today’s check register, the bills and claims and August financial statements.

ORDINANCE AND RESOLUTIONS
Ordinance 15-2018, an ordinance amending section 151.82(B) of the Village of Navarre Codified Municipal Regulations, was given a third and final reading. Ms. Winkhart offered, Ms. Keith seconded Ordinance 15-2018 be placed in final passage. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Motion carried. Ordinance 15-2018 duly adopted.

Ordinance 16-2018, an ordinance for the 2019 Tax Budget was given a second reading by title only.

Ordinance 17-2018, an ordinance approving replots of Lots 159 & 161 for Center Square Properties to be passed as an emergency. Ms. Winkhart offered and moved to accept Ordinance 17-2018 and declared same to be an emergency. Mr. Netzly seconded. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Motion carried. Ordinance accepted.

Resolution 2018-10, a resolution authorizing Kimble for the Village garbage and rubbish collection. Mr. Netzly motioned, Mr. Berkey seconded that the Village does not move forward with the bid contract. Netzly yes, Rouse yes, Keith yes, Hattery yes, Berkey yes, Winkhart yes. Six yes votes. Resolution 2018-10 no action taken.

Resolution 2018-11, a resolution authorizing the Village to enter into a land use agreement for Day Avenue. After some discussion the resolution was tabled and will be sent to the Buildings and Land Committee for consideration.

SOLICITOR
Village Solicitor Attorney Terry Seeberger reported after the last meeting, he proposes changing the ordinance to include a non-profit entity operating on land owned by the Village.

Attorney Terry Seeberger has prepared a complaint against AT&T to be filed in Common Pleas Court.

Attorney Terry Seeberger reported that the owner of 47 Canal Street West is to be arraigned tomorrow. There is potentially a new property owner.

STREETS AND ALLEYS
The yard waste pit at the Waste Water Treatment Plant is open Monday – Friday from 7:30am to 3pm and weekends and holidays from 8:30 am to 11am.

Stop signs are being installed on alleys that do not have them.

UTILITIES
New pontoons have been installed on the clarifiers at the Waste Water Treatment Plant.

Lead and copper samples were collected last week.


MISCELLANEOUS
Mosquito spraying in the Village is set for tonight, September 4, 2018.

The bridge at the gulley field should be torn out this week.

The air conditioning unit at the civic center is set to be replaced next week.

Thanks to village employees Blake Dibell and Dustin Taylor for helping with the water leak on Main Street.

Navarre Zoning Inspector Jim Neely advised that 123 Park Street NW has a new roof and new gutters, and more work is to be done. The contractor is working with Mr. Coffey for his house.

Jim Neely reported that garbage has been cleaned up at 239 Park Street NW and that gutter work is to be done on the property in addition to the garage door being repaired.

Jim Neely said no one else has responded and the Property Maintenance Committee will decide who we should prosecute next.

Mayor Benson stated that the Navarre Park Board met with the Navarre Baseball and Softball Association and the YMCA and discussed moving the softball field. Navarre Baseball Park Board will decide the new location.

Mr. Netzly advised the Street Committee is to meet to discuss garbage pick-up times, rules for alleys and possible permits.

September 13, 2018 at 4:30 pm Malone College will hold a meeting for a county wide first responder radio system for Stark County Council of Governments.

There will be a Special Council Meeting on Monday, September 10th at 7:00 pm to discuss property acquisition.
