Session 6, March 16, 2015

Mayor Robert Benson called the 6th Regular Session of Council to order on Monday, March 16, 2015. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Derek Netzly, Daniel Rouse, Don Berkey, Matt Feucht, and Ray Gallaher. Gary Wilson was excused. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Fire Chief Shane Stantz, Village Solicitor Attorney Terry Seeberger, Vicky Owen-Merry, Linda Dillon-Young, Darlene Lutz, LaRue Wetter and The Independent Reporter Devon McCarty. 

Mr. Netzly moved to approve the minutes of the Regular 5th Session of Council held on March 5, 2015. Mr. Berkey seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. Minutes approved. 

PUBLIC PARTICIPATION

Darlene Lutz wondered if the Railroad sign can be removed from her property. Mayor Robert Benson will contact the Street Department and discuss relocation of the sign. 

VONBA representative Vicki Owen-Merry stated that the business organization would like to have three bicycle statues built and placed in various locations throughout the Village. Ms. Owen-Merry distributed pictures of the statues the organization would like to purchase. Mr. Netzly made a motion to give permission to VONBA to purchase the statues and have them installed by Village Employees. Mr. Feucht seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. 

FIRE SAFETY

Fire Chief Shane Stantz distributed and reviewed the January and February monthly reports to council. 

Chief Stantz informed council that no cause of the fire on Wooster Street had been determined as yet. The Fire Marshall has not issued a report to date. 

FINANCE

Clerk-Treasurer Anne Johnson gave council a copy of the check register for approval. Council gave approval. 

ORDIANCE AND RESOLUTIONS

Ordinance 7-2015, an Ordinance amending Navarre Municipal Regulations 53.01 Solid Waste Management Plan and declared an emergency. Mr. Netzly offered and moved to accept Ordinance 7-2015 and declaring same to be an emergency. Mr. Feucht seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. Ordinance accepted. 

Ordinance 7-2015, Mr. Berkey moved, Mr. Gallaher seconded rules requiring three separate reading of Ordinance 7-2015 be suspended. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Rules requiring three separate readings suspended. 

Ordinance 7-2015, Mr. Berkey moved, Mr. Gallaher seconded Ordinance 7-2015 be placed in final passage. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. Ordinance 7-2015 duly adopted.

Ordinance 8-2015, an Ordinance authorizing competitive solicited proposals for electric service at the Water Treatment Plant and the Wastewater Treatment Plant and declared an emergency. Mr. Gallaher offered and moved to accept Ordinance 8-2015 and declaring same to be an emergency. Mr. Netzly seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. Ordinance accepted.

SOLICITOR

Attorney Seeberger explained the need for Ordinance 7-2015 and Ordinance 8-2015 and the reason why they had to be passed as an emergency. 

MAYOR

Mayor Benson announced that there will be a benefit dinner, raffle and bake sale for the victims of the fire on March 28, 2015 at St Clements from 4:00 P.M. until 8:00 P.M. 

The collection at the Lenten Service on March 29, 2015 at St Paul’s will also be donated.

Mayor Robert Benson extended his thanks to Attorney Terry Seeberger and Denny Fulk for their participation in the Navarre Zoning Seminar. 

Stark-Tuscarawas-Wayne Joint Solid Waste Management District has ended Navarre’s no cost collection of yard waste. The Mayor stated that Navarre council has elected to continue the service to residents at Village expense. 

Mayor Benson distributed an e-mail from Stark Parks concerning the 5K race in Navarre. The Mayor would like the Parks Committee to review options for the date of the race. 

MISCELLANEOUS

Mr. Netzly thinks serious consideration should be given to the purchase of the Weisgarber property that is going up for auction. 

It was decided to hold a special council meeting on March 23, 2015 at 7:00 P.M. to discuss the land purchase. 

Mr. Netzly feels that council should re-evaluate the Property Management Code. They should look into redoing the Residential Zoning and incorporate it into the Property Management Code. Mr. Netzly stated that there was never a Public Hearing for the Property Management Code.

BILLS AND CLAIMS

Mr. Netzly moved to approve bills and claims in the amount of $108,563.21. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Motion carried. Bills and claims approved. 

Mr. Gallaher moved, Mr. Berkey seconded to adjourn the meeting. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes. Five yes votes. Meeting adjourned.
