Session 1, January 5, 2015

Mayor Robert Benson called the 1st Regular Session of Council to order on Monday, January 5, 2015. Mayor Benson began the meeting with a prayer and led the Pledge of Allegiance. Members answering roll call were Gary Wilson, Daniel Rouse, Don Berkey, Matt Feucht, Ray Gallaher and Derek Netzly. Also attending the meeting were Clerk-Treasurer Anne Johnson, Village Administrator Jeff Seward, Police Chief Dennis Albaugh, Sergeant Chris Hummel, Patrolman Chad Shetler, Patrolman Joe Hill, Patsy Benson, Patty Colucy, Chris Roberts, Pat Winkhart, Friends and Family of the Police Department and The Evening Independent Reporter Devon McCarty. 

In the first order of business Mayor Robert Benson requested nominations for president pro temp. Mr. Wilson moved to open the nominations. Mr. Feucht seconded. Wilson yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Netzly yes. Six yes votes. Motion carried. Nominations opened. 

Mr. Berkey nominated Gary Wilson for president pro temp. Mr. Feucht nominated Derek Netzly for president pro temp. Mr. Netzly declined the nomination. Mr. Berkey moved to close the nominations. Mr. Wilson seconded. Wilson yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Netzly yes. Six yes votes. Nominations closed. 

Mr. Gallaher moved, Mr. Rouse seconded to elect Gary Wilson as president pro temp. Wilson yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Netzly yes. Six yes votes. Gary Wilson elected president pro temp for 2015. Mr. Wilson and Mr. Netzly changed seats. 

Mr. Gallaher moved, Mr. Wilson seconded to approve Council Rules for 2015. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. 

Mr. Berkey moved to approve the minutes of the Regular 22nd Session of Council held on December 16, 2014. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Minutes approved. 

PUBLIC PARTICIPATION

Chris Roberts stated that some parts of town are a lot darker than other areas. He also feels that there is a lot of negative press in the media about police and he thinks that our department deserves recognition for the good job they do. 

SAFETY POLICE

Chief Dennis Albaugh, Navarre Police Department, presented the yearly police report along with the monthly report to council. 

Police Chief Dennis Albaugh requested that the Mayor appoint Dan Kirby, Daniel Yeager, Justin Lambert, James Welch, Mitch King, Mark Weldon, Robert Durben and Joshua Barrick to the Auxiliary Unit. Mayor Robert Benson appointed them to the Navarre Auxiliary Police Unit and requested council’s consent. Mr. Netzly moved to accept the appointments. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Consent given. 

Chief Dennis Albaugh requested that Mayor Benson make the following promotions; Sergeant Hummel to Lieutenant, Patrolman Shetler to Sergeant and Patrolman Hill to Detective. 

Mayor Robert Benson requested council’s consent to promote Patrolman Hill to Detective. Mr. Netzly moved to promote Patrolman Hill to Detective. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Patrolman Hill is now Detective Hill. 

Mayor Benson requested council’s consent to promote Patrolman Shetler to Sergeant. Mr. Netzly moved to promote Patrolman Shetler to Sergeant. Mr. Wilson seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Patrolman Shetler is now Sergeant Shetler. 

Mayor Benson requested council’s consent to promote Sergeant Hummel to Lieutenant.  Mr. Gallaher moved to promote Sergeant Hummel to Lieutenant. Mr. Berkey seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Sergeant Hummel is now Lieutenant Hummel. 

FINANCE

Clerk-Treasurer Anne Johnson gave council her December financial statements and a list of bills prepared for payment approval. Council gave approval. 

ORDINANCE AND RESOLUTIONS

Ordinance 5-2014 – Mr. Gallaher moved to accept Ordinance 5-2014, an Ordinance adopting amendments and/or additions to Chapter 151, of the Village of Navarre Code of Ordinances. Mr. Wilson seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. The first reading was given. 

Ordinance 6-2014 – Mr. Wilson moved to accept Ordinance 6-2014, an Ordinance amending the Official Zoning Map of the Village of Navarre. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. First reading was given. 

Mayor Robert Benson requested a motion from council to run a legal of Public Hearing for Ordinance 5-2014 and 6-2014 to be held at Village Hall on February 16, 2015 at 6:30 P.M. Mr. Gallaher moved to approve the request from the Mayor to hold a Public Hearing for Ordinance 5-2014 and Ordinance 6-2014. Mr. Feucht seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. 

Resolution 2015-1, a Resolution giving consent to the Director of Transportation for the State of Ohio for projects that will begin construction in fiscal year 2015. Mr. Netzly offered and moved to accept Resolution 2015-1. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Resolution 2015-1 accepted. 

SOLICITOR

Mayor Robert Benson has received three qualified applications for the position of Village Solicitor. Interviews with the candidates, council, Village Administrator Jeff Seward and Mayor Benson are scheduled for January 13, 2015. 

MAYOR

Mayor Robert Benson made the following appointments for 2015 and requested council’s consent. 

Christopher Pittman, Cemetery Sexton. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Consent given. 

Marcia Comer, Cemetery Clerk. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Consent given. 

Clarence Cole, Navarre Zoning Inspector. Mr. Cole will replace Rebecca Gilbert who is retiring. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Consent given. 

Matt Farmer to the Navarre Board of Zoning Appeals. Mr. Farmer will replace Clarence Cole, who served on the Navarre Board of Zoning Appeals as Chairman. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Consent given. 

Chris Roberts to the Navarre Planning Commission. Mr. Roberts will replace Billy Jacobs. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Consent given. 

Mayor Benson respectfully and sincerely thanked Rebecca Gilbert for the many years served as Navarre’s Zoning Inspector. 

Mayor Robert Benson also expressed gratitude to Billy Jacobs for his service as a member of the Navarre Planning Commission. 

Mayor Benson informed council that the State of the Village for 2015 will be given at the next council meeting on January 19, 2015 

STREETS AND ALLEYS

Brush pick-up for 2015 will begin on April 6, 2015. Until that time brush and yard waste can be taken to the Waste Water Treatment Plant Monday through Friday from 7:00 A.M. until 3:00 P.M. and on weekends and holidays from 8:30 A.M. through 11:30 A.M. 

Christmas tree pick-up will continue through January 23, 2015. Trees should be placed in the tree lawn and residents should call Village Hall to schedule pick-up. 

Road salt was ordered since the last council meeting. 

Christmas decorations were taken down. 

UTILITIES

The results of this year’s storm water program audit were received and the Village’s response is due by the end of the month. 

The annual sludge report for the Waste Water Treatment Plant is due by the end of the month. 

The sewer jetter was picked up. 

The brakes on the water truck need repaired. 

MISCELLANEOUS

The annual PERRP report is due by February 1, 2015. 

Parts for the ornamental gas lamp on Rochester Square are expected in by the end of 

The Municipal Road Fund application is due January 31, 2015. 

Village Administrator said no word yet on purchase agreement for the property for the water tower. 

Mr. Wilson thanked council for electing him as president pro temp. 

Mayor Benson requested a safety committee meeting to discuss the Police Clothing Allowance for 6:00 P.M. on January 19, 2015 

BILLS AND CLAIMS

Mr. Netzly moved to approve bills and claims in the amount of $94,139.87. Mr. Gallaher seconded. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Bills and claims approved. 

Mr. Berkey moved, Mr. Feucht seconded to adjourn the meeting. Netzly yes, Rouse yes, Berkey yes, Feucht yes, Gallaher yes, Wilson yes. Six yes votes. Motion carried. Meeting adjourned.
